RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ORDERING
VACATION OF THE 17.5 FOOT NORTHERN PORTION OF BUTTERCUP
UU~E BETWEEN WESTWOOD DRIVE AND FILLIPELLI DRIVE IN THE
CITY OF GILROY, RESERVING PUBLIC FACILITY EASEMENTS.
WHEREAS, the Council of the City of Gilroy did on November 7,
1977, adopt Resolution No. 77-66 declaring its intention to proceed
under the Street Vacation Act of 1941, Streets and Highways Code
Section 8300, et. ~. to v~cate the 17.5 foot northern portion of
Buttercup Lane, but not the public facility easements, between
Westwood Drive and Fillipelli Drive in the City of Gilroy as shown
upon the map attached hereto, and
WHEREAS, notices of the adoption of such resolution were
published and posted as required by law, and
WHEREAS, no objection to the proposed vacation of the portion
of the city street was filed at or before the hea~ing by the Council
on December 5, 1977, at 8:00 p.m. in the Council Chambers in the
City Hall at 7390 Rosanna Street, Gilroy, California, the time and
place fixed for the hearing in said notices, and the hearing having
been duly held, and the Council having duly considered the evidence
presented as to the vacation of the portion of the city street
described herein;
The Council does hereby find that the described portion of the
city street is unnecessary for present or prospective public use.
The Council further finds that public convenience and necessity
require the reservation of easements enumerated in Streets and
Highways Code Section 8330 for all public facilities across, above
and under the described easement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Gilroy that the described emergency access easement ~ va~ated, but
