RESOLUTION NO. 83-26
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
ORDERING VACATION OF THIRTY-FIVE FOOT ONE-HALF
STREET RIGHT-OF-WAY AND PORTION OF PUBLIC SERVICE
EASEMENT ON BREM LANE, RESERVIN(; TO THE CITY AN
EASEMENT FOR PUBLIC UTILITY FACILITIES
WHEREAS, the Council of the City of Gilroy did on
March 7, 1983, adopt Resolution No. 83-19 declaring its intention
to proceed under the Public Streets, Highways and Service
Easements Vacation Law to vacate the thirty-five foot one-half
street right-of-way and portion of public service easement on
Brem Lane, but not the north lO foot public utility easement,
as shown upon the map attached hereto; and
WHEREAS, notices of the adoption of such resolution were
published and posted as required by law; and
WHEREAS, no objection to the proposed vacation was filed
at or before the hearing by the Council on April 4, 1983, at
8:00 o'clock p.m., in the Council Chambers in the City Hall
at 7351 Rosanna Street, Gilroy, California, the time and place
fixed for the hearing in said notices. and the hearing having been
duly held, and the Council having duly considered the evidence
presented as to the vacation described herein;
The Council does hereby find that the described unnamed
one-half street right-of-way is unnecessary for present or
prospective public use.
The Co~ncil further finds that public convenience and neces-
sity require the reservation of a public utility easement as
enumerated in Streets and Highways Code Section 8340 for public
facilities across, above and under the north lO feet of the
described easement.

NOW, THEREFORE, BE IT RESOLVED by the Council of
the City of Gilroy that the described strip of land be
vacated, but that a permanent easement for public utilities
enumerated in Streets and Highways code Section 8340 across,
above and under the north lO feet of the described strip
of land be reserved to the City as shown upon the map attached
hereto.
PASSED AND ADOPTED this 4th day of April, 1983, by the
following vote:
