Steinmetz,CityClk City of Gilroy 7351 Rosanna Street Gilroy, CA 95020 NO FEE PER GC SEC 6103 9749797 K 595PAGE2141 AGREEMENT The undersigned ("Owner"), being the owner of that certain real property located in the City of Gilroy, County of Santa Clara, California, commonly known as , AP~ ,8 ')-0/:) -? 0 ~\{Ct.,L .MJ ~rn~~ and legally described as 1 b "~~ 7 -- Z-O) (the "Property") does hereby acknowledge and represent to the City of Gilroy ("City") as follows: 1. Prior to framing any structure to be located on the Property, Owner shall install and maintain an elevated tank or tanks containing 10,000 gallons of water at a location(s) approved by the City to be used for fire protection. Said tank(s) shall be maintained until such time as a zone II or III water line is connected to the existing water lines serving the Property for domestic and fire protection purposes. 2. Owner acknowledges that the City currently maintains a domestic and fire protection system serving the adjacent area consisting of a 10,000 gallon reservoir, booster pumps and fire hydrants. This system will be available to owner until the new water main as hereinafter set forth is installed. The developers of tract # 7350 will provide adequate domestic and fire flow for the area by installing a water main to connect to the Zone III water system and will pay the pro rata share of costs for all homes within Parcel Map 506/47 and Tract 7350 connected to the Zone II and Zone III system. Other than installation of the water main, and payment of paid pro rata costs, the said developers have no responsibility relative to the Zone II and Zone III water system facilities to be installed by Country Club Estates. 3. Owner, Transferees and other related parties shall hold the City harmless and free from any liability in the event of fire damage to any structure located on the Property. 4. Owner acknowledges receipt of Requirements for Development prepared by City of Gilroy Fire Marshal as attached hereto as Exhibit "A". Owner agrees with City that all construction on the property will be in compliance with said requirements as set forth on Exhibit "A". If the Country Club Estates project does not go forward, the Owner agrees to provide permanent facilities for domestic water and fire flow to City standards. This Agreement shall be binding upon the Assignees and Transferees of the Owner and shall be recorded and shall run with the land. This Agreement shall remain in force until such time as the said zone II or III water lines are connected to the Property as approved by the City and, thereafter, this Agreement shall be null and void and shall be removed from record.
