(NOTICE OF ABANDONMENT)
Under Section 3117 of the California Streets and Highways Code, the undersigned City
Clerk of the City of Gilroy hereby certifies that the attached is a full and correct copy of a
Resolution Declaring Results of Special Election and Directing Recording of Notice of
Abandonment adopted by the City Council of the City on May 21, 2001 in the proceedings for
the City's Community Facilities District No.1 (the "CFD") under a Resolution of Intention
adopted September 7, 1999 and for which a Boundary Map was recorded in the Santa Clara
County Recorder's Office in Book 34 at Page 23 of Maps of Assessment and Community
Facilities Districts, and to which Resolution and Map reference is hereby made for all
particulars. Notice is hereby given that the proceedings of the City Council in and for the CFD
have been formally abandoned.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
DECLARING RESULTS OF SPECIAL ELECTION
AND DIRECTING RECORDING OF NOTICE OF ABANDONMENT
Community Facilities Disbict No.1
RESOLVED, by the City Council (the "Council") of the City of Gilroy (the "City"),
County of Santa Clara, State of California that
WHEREAS, in proceedings heretofore conducted by this Council pursuant to Mello-
Roos Community Facilities Act of 1982, Olapter 2.5 of Part 1 of Division 2 of Title 5,
commencing with Section 53311, of the California Government Code (the "Act"), this Council
adopted on September 7, 1999, its Resolution No. 99-76, being a resolution of intention (the
"Resolution of Intention~) to establish the City's Community Facilities District No.1 (the
U CPDU);
WHEREAS, under the Act and subsequent proceedings under the Resolution of
Intention, this Council conducted a special election in and for the CPO among the resident
registered voters of the CPO on March 7, 2000 on the of the levy of a special tax within the CPO
to pay for fire protection services;
WHEREAS, at the election, the issue presented failed to receive the approval of at least
2j3rds of the qualified voters voting at the election
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:

1. Measure Not Approved. This Council hereby formally determines that the issue of
the levy of the special tax for the CPO failed to receive the approval of 2/3rds of the qualified
electors voting at the special CPD election as required by the Act.
2. Proceedines Abandoned. Based upon the result of the election" this Council hereby
orders that all proceedings for the CPO be abandoned and that the City Clerk shall cause to be
prepared and recorded a suitable notice of abandonment of proceedings pursuant to Section
3117 of the California Street and Highways Code.
3. Resolution Effective. This Resolution shall take effect upon its adoption.
