AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING MAPLE
STREET BETWEEN 7TH STREET A:t\TD OLD GILROY STREET IN THE CITY OF
GILROY
WHERF..AS the Common Council of the City of Gilroy did on the
19th day of August, 1953 duly pass and adopt Ordinance No. 509
whereby it declared its intention to proceed under the Street
Vacation Act of 1941 and vacate that portion of Maple Street in
the City of Gilroy, lying between 7th Street and Old Gilroy Street,
reserving and excepting easements and rights as hereinafter set
forth and the said Council having inm,id ordinance fixed Tuesday,
the 8th day of september, 1953 at the hour of 8:00 P.M. in the Common
Council Chambers in the City Hall as the hour and place for hearing
objections to the said proposed vacation; and
WHEREAS the City Clerk of the City of Gilroy did cause notice
of the time and place of the s aid hearing to be published and posted
in accordance with the order of the Con~on Council and in accordance
with law and said hearing having been held at the time and place
specified and no one appearing to object to said street vacation;
THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN

Section 1: Maple Street in the said City of Gilroy between
7th Street and Old Gilroy Street is hereby abandoned and vacated;
provided, however, that in the vacat1.on of said street the City of
Gilroy does hereby reserve and except the permanent easement and
right at any time or from time to time to construct, maintain,
operate, replace, remove and renew sanitary and other sewers and
drain and water pipe lines and storm drains in, upon, over and across
the part of said Street so vacated, and pursuant to any franchise
to
thereof or renewals thereof, or otherwise, to construct. operate.
maintain, replace, remove, renew, and enlarge lines of pipes, conduits.
cables, wires, poles and other convenient structures, equipment, and
fiXtures for the operation of gas pipe lines, telegraphic and telephone

lines, and for the t~ansportation or distribution of electrical
energy and water.
Section 2: This ordinance shall take effect and be in full
force from and after the date of its passage and approval.
ADOPTED AND PASSED This 8th day of September, 19,3, by the
