Ordinance No. 591 19.11 1560,g6 If 800(4268 PAGE i26 ORDINANCE NO. ...i2L AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING THE NORl'HWESTERLY TWENTY-TWO (22) FEET OF A TEN FOOT ALLEY OR RIGHT OF WAY, THE CENTER LINE OF WHICH IS THE LINE DIVIDING LOTS 53 AND 54 ON TRACT NO. 1784 SHERWOOD PARK UNIT NUMBER ONE. THE COIVJ,'ION COUNCIL OF THE CITY OF GILROY having on the 17th day of Novem- ber, 1958, duly passed and adopted Ordinance 587 whereby it declared its inten- tion to proceed, under the Street Vacation Act of 1941, and vacate a certain street, public alley, or thoroughfare in the City of Gilroy hereinafter described. And, the City gle~k of the City of Gilroy having caused notices of the pass- ing of said Ordinance to be published in The Gilroy Evening Dispatch, a news- paper of general circulation, in the manner and form required by law; and the said street, public alley, or throughfare having been posted in the manner and form required by law; and no objection to said proposed vacation of said street, pub- lie alley or thoroughfare having been filed at or before the hearing held by said council on the 15th day of December, 1958, at 8:00 p.m. o'ClOCk, at the Common Council Chambers in the Wheeler Municipal Auditorium, at Sixth and Ros- anna Streets, in the City of Gilroy, California, and the said Common Council having duly considered the matter of vacating the said street, public alley or thoroughtare, which is hereinafter described: THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN AS FOLLOWS: SECTION I: The following described street, public alley within the said City is hereby vacated and abandoned~ All of the following described alley, or right of way or easement: The Northwesterly twenty-two (22) feet of a strip of land of a uniform width of ten (10) feet, the center line of which is the line dividing Lots 53 and 54 of Tract No. 1784 Sherwood Park Unit No.1, as shown upon the map thereof on record in the County Recorder's Office of Santa Clara County, in Map Book 71, pages 28 and 29. SEGl'ION II: The vacation and abandonment of the said alley or right of wy J i or easement hereinbefore described shall in no way affect the right of way, if any, in said alley, right of way or easement now held by the Pacific Telephone and Telegraph Company as set forth in the right of way agreement now of record with the Recorder of Santa Clara County, or any right of way heretofore granted to the Pacific Gas and ~lectric Company or its predecessor at interest, the Coast Counties Gas and 1!;lectric Company or of the City of Gilroy to repair or re- - 1 - Boo('4268 PAGf127 place any water, drainage or sewer lines now in or on said premises. SEarION III: The Ordinance shall take effect and be in force from and after the date of its passage and approval.
