I tt::.- ~' \;)~ eoo~ 7625 ;J,'M n82 ,?1 ~ ORDINANCE NO. ~ AN ORDINANCE OF THE CI'l'Y OF GILROY VACATING .ANI) ABANDONING ALL THAT PORTION OF MAPLE S'l'RElrl' BB'rWBBN BIGH'l'H STRBBT AND OLD GILROY S'l'RlmT WHEREAS, the Council of the City of Gilroy has heretofore and on the ..2!!L day of December, . u_; 19~.6, passed and adopted Resolution No. 1065 declaring 1ts intention to proceed under the street Vacat~on Act pi 1941 to vacate a portion of a certain street in the City of Gilroy hereinafter described; and WHEREAS, the City Council of the City of Gilroy, in accordance with said Str,et .Vacat~on A~~~9f .1941,haa caused notices of the adoption of said resolution to be published 1n the Gilroy Evening Dispatch, a newspaper of general circulation; published in the said City of Gilroy, in the manner and form required by law, and the said street or thoroughfare has been posted in the manner and form required by law; and WHEREAS, no Objection to the said proposed vacation of said street has been filed at. or before the hearing held by said council on the 3rd day of January, 1967, at the hour of 8:00 o'clock p.m., at the COUncil Chambers in the City Hall, at. No. 10 Sout.h Rosanna street; in t.he said City of Gilroy; the time and place fixed for the hearing in said not.ices; and the said hearing has been held at the said time and place; and the council has duly considered the matter of vacat.ing the said street, as the same is hereinafter described and has determined that sa.id premises are no longer needed or required for public purposes by the said City of Gilroy. NOW THEUFORB, the Council of the City of Gilroy does ordain as follows: Section 1" The following described portion 0 f Maple St.reet, being the premises hereinbefore mentioned, within the said City of Gilroy, is hereby vacated and abandoned: . (1) 800~ 762'0 r,~GE 683 All that portion of Maple street in the said City of Gilroy lying between Eighth street and Old Gilroy street. section 2.. The council does declare t.hat the public convenience and necessity requires the reservation of easement and right-of-way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, and the vacation and abandonment of the portion of Maple Street hereinabove described shall be and is subject to the reservation and exception of the permanent ease- ment and rightat. any time or from time to time of the Cit.y of Gilroy to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and 1ts products, ammonia, water, and incidental purposes, including' access and the riqbt to k.eep the property free from inflammablle;, materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. Sec~~on 3.. This ordinance shall tak.e effect and be in full force thirty (30) days from and after its passa9'e and approval.. sect~9n 4.. The foregoing ordinance was introduced at a regular meeting of the council and ordered published by title and summary at a regular meeting of the City Council held on the 3rd day of January, 1967, and was finally adopted and passed at a reqular .
