Type of Project: (Mark applicable section for Grantee's project) SECTION 94Y5, WELFARE AND INSTITUfIONSCODE o (a) A recipient of a contract for the acquisition of a facility to be used as a senior center shall assure that the facility will be used for that purpose for at least 10 years from the date of acquisition. Xl (b) A recipient of a contract for the renovation of an exist~ng facility to be used a senior center shall assure the department the facility will be used for that purpose for the following periods: o (1) Not less than three years from the date the contract terminates, where the amount of the award does no .:xceed thirty thousand dolla.rs ($30.000). o (2) If the award exceeds thirty thousand dollars ($30.000), the fixed period of time shall increase one year for each additional ten thousand dollar ($10.000) or part thereof. to a maximum of seventy-five thousand d0._:l.rs ($75,000). tiCk 0) Fqr awards which exceed seventy-five thousand dollars (STS.OOO), the fixed period of time shall not be less than 10 years. WELFARE AND INSTITUTIONS CODE (a) The State of California sha.ll be entitled to recapture a portion of stale fu as from the owner of a facility, if within 10 years after acquisition or 20 years after completion of construction, either of the following occurs: (1) The owner of the facility ceases to be a public or nonprofit agency. (2) The facility is no longer used for senior center activities. (b) The amount recovered shall be that proportiDn of the current vo.1ue of the facility equal to the proportion of state funds contributtd to the original cost. The current value of the facility shall be determined by an agrecmen~ between the owner of the facility and the State of California, or by an action in the court in the jurisdiction in which the fa.cility is located. Le2al Description (Include senior center name and address. and a description of the acquisition, renovation or construction accomplished pursuant to the Senior Center Bond Act): The City of Gilroy is applying for $225,000 SCBA Funds for an overall $470,350 Phase I project cost. Senior Bingo Funds of $100,000 will be used as a supplemental funding. $7,000 has been expended for the completion of the Senior Center Master Plan which will be utilized for all construction and renovation purposes.
