CE: 95-036; APN: 799-07-018 Dear Mr. Vasquez, On 4-19-95, Correction Notice #0717 was issued to stop work on the illegal rear structure, remove all electrical and plumbing service to the structure, and to obtain a new permit from the City Building Division to demolish the structure. Later that day you spoke to Sr. Planner, Bill Foss, regarding a way to legally convert the structure into a granny unit as a possible option to demolition. You were advised by Mr. Foss to submit a site plan to the Planning Division for reVIew. As of that date, a site plan has not been submitted and various attempts to contact you by phone have failed. Therefore, this letter will serve as an Official Notice and Order that: Any repair work on the illegal rear unit must permanently cease. The following items must be completed by 6-8-95, unless other arrangements are made: 1. Rear unit must be vacated. 2. All electrical and plumbing service to rear unit must be removed. 3. Demolition permits must be obtained from the City Building Division. 4. Rear unit must be properly demolished and cleared away. An inspection will be made on or after the above date to verify compliance. Failure to comply may result in the issuance of a citation which generally requires a court appearance. N 9 2 0 PA GE I 995 The violation items listed are violations of the Uniform Housing Code (UHC). The dwelling units are currently substandard as defined in Chapter 10 of the UHC and is violating Section 202 of the same code. The UHC Section 201(c) reads in part: "Every owner remains liable for violations of duties imposed on the occupants of the building". Section 202 of the code states: "All buildings or portions thereof which are to be determined to be substandard as defined in this code are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the procedure specified in Chapter 11 of this code." Any person having record title or legal interest in the building may appeal from the notice and order or any action of the Building Official within thirty (30) days from the date of service of such notice and order. Failure to appeal will constitute a waiver of all right to an administrative hearing and determination of the matter. If you wish to appeal this decision, there is an appeal fee of $448.00. This fee is subject to change. In order to resolve this matter, the areas in question must be brought into compliance with all City laws and ordinances.
