SANTA CLARA VALLEY WATER DISTRICT, a public corporation (District),
does hereby grant to the CITY OF GILROY, a municipal corporation of the
State of California, all that certain real property in the City of Gilroy,
County of Santa Clara, State of California, described as follows:
Being a portion of those lands conveyed to Santa Clara County Flood
Control and Water Conservation District (now Santa Clara Valley Water
District) by deed from Richard Erem and Marian S. Brem as recorded
in Book 4990 of Official Records at page 179; and by deed from
Alvin Noll, et UX., as recorded in Book 5024 of Official Records
at page 127; being more particularly described as follows:
Beginning at a point on the line common to Ranch Lots 47 and 48
being distant 1318.48 feet 'more or less from the easterly cornman
corner thereof, as they are shmm upon Map No. 7 accompanying the
final report of the referees in the Las Animas Rancho Partition
Suit (Superior Court Case No. 5536) in and for the County of Santa
Clara, and as shown on that Record of Survey filed in Book 69 of
~laps at page 17, Santa Clara County Records, thence from said
point of beginning N 00012'20"E 27.50 feet to the southerly boundary
of lands conveyed to Gilroy Corporation by deed recorded in Book G 310
of Official Records at page 506; thence along said 'southerly boundary
and running parallel to and 27.50 feet distant from said cornmon
Ranch Lot Line N 89047'48"\11 86.00 feet to a point that is 240.15 feet
distant from the southwesterly corner of said Lands of Gilroy Corporation;
thence leaving said southerly boundary S 00012'20"\11 27.50 feet to
said cornmon Ranch Lot Line; thence continuing S 00012'20"\11 27.50
feet to a point in the northerly boundary of land conveyed to Val
A. Filice, et al., by deed recorded in Book 6887 of Official Records
at page 687; thence along said northerly boundary and running parallel
to and 27.50 feet distant from said cornmon Ranch Lot Line S 89047'
48"E 86.00 feet; thence leaving said northerly boundary of Lands of
Filice N 00012'20"E 27.50 feet to the point of beginning.
Containing 4730 square feet or 0.109 acre of land, more or less.

RESERVING NEVERTHELESS, unto Grantor an easement to construct, reconstruct,
inspect, maintain and repair channel protection works and appurtenant structures
within the above-described parcels; provided that this reservation and nothing
herein contained shall be construed as an assumption or acceptance by Grantor
District of responsibility for the construction, reconstruction, repair and
maintenance in a condition not dangerous or defective of any roadway or
structure erected by Grantee City across said channel or within said easement
area.

hereby certify that pursuant to the authority given by Resolution
No. 944. adopted by the Council of the City of Gilroy on the 6th
day of July, 1965, at a regular meeting of said Council, a certified
copy of which resolution is on record in the office of the County
Recorder of the County of Santa Clara, State of California. in Book
7027. page 228, I, as said City Administrator, do hereby accept on
behalf of the said City the conveyance to the City of Gilroy by
Santa Clara Valley Water District

AUTHORIZING CONVEYANCE OF INTEREST IN REAL PROPERTY
BE IT RESOLVED by the Board of Directors of SANTA CLARA VALLEY WATER
DISTRICT as follows:
1. THAT the interests in real property of this District to be conveyed are
described in "Exhibit A", so marked and attached hereto, and are not required for the
uses and purposes of the District; and
2. THAT the Chairman of the Board be and is hereby authorized to execute and
deliver the deed of the District to the property as described in said Exhibit A to

a municipal corporation, within the said District.
