hereby GRANT to the City of Gilroy, a municipal corporation of the State of California,
"GRANTEE", a perpetual exclusive easement for public ingress and egress, public utilities and
other public purposes, in, under, over, upon and across all that certain real property situated in
the City of Gilroy, County of Santa Clara, California, described in Exhibit "A" and shown in
EXHIBIT "B", both attached hereto and made a part thereof.

LEGAL DESCRIPTION OF EASEMENT FOR PUBLIC USE
ALL THAT REAL PROPERTY situated in the City of Gilroy, County of Santa
Clara, State of California, described as follows:
BEING a portion of Lot Seven(7) in Block Two(2) South Range 4 West, as
designated upon Map No.6, accompanying the Report of the Referee and
its amendments in the Partition Suite of Henry Miller, et al;
Plaintiffs vs. Massey Thomas, et al as described in that Grant Deed
from Citibank, N.A., as Trustee for Certificateholders of Structured
Asset Mortgage Investment II Trust 2007-AR6, Mortgage Pass-Through
Certificates, Series 2007-AR6 to Mohammad H. Bakhtar and Farahnaz
Rashtchizadeh, Trustees of the Bakhtar Family Trust dated October 1,
2007, recorded in Document No. 21005026, Santa Clara County Records
and more particularly described as follows:
BEGINNING at the Northwest corner of West Eighth Street and Rosanna
Street; thence along the Northwesterly line of West Eighth Street and
the Southeasterly line of said Lot Seven(7) South 70000'00" West 150.00
feet to the Southwesterly corner of said Lot Seven(7) and TRUE POINT
OF BEGINNING; thence along Southwesterly Line of said Lot Seven(7)

Trustees of the Bakhtar Family Trust
This is to certify that the interest in real property conveyed by the grant deed dated May 11,2011
from Mohammad H. Bakhtar and Farahnaz Rashtchizadeh, Trustees of the Bakhtar Family Trust, to
the City of Gilroy, a municipal corporation of the State of California, is hereby accepted by the
undersigned officer or agent on behalf of the City of Gilroy pursuant to authority conferred by
Resolution No. 200S-56 of the City of Gilroy adopted December 15, 200S, a certified copy of which
resolution is on record in the office of the County Recorder of the County of Santa Clara, State of
California, document #20093294, dated January 9, 2009 and the grantee consents to recordation
thereof by its duly authorized officer.
