The undersigned further irrevocably offers to dedicate to the City of Gilroy for the use of the public a sanitary sewer easement over, under, on and across the real property hereinafter described, said dedication to be accepted only when the City Coun- cil of the City of Gilroy adopts and records in the office of the Recorder of the Coun- ty of Santa Clara a resolution accepting said easement. Until said easement is record- ed the City of Gilroy shall not be responsible for maintaining said easement of and im- provements thereon. If any change in alignment, length or width of easement approved by the City of Gilroy results in vacation of any part of the real property dedicated herein, such vacation shall terminate the dedication as to the part vacated. The provisions hereof shall inure to the benefit and be binding upon the heirs, successors, assigns and personal representatives of the respective parties hereto. Parcel One BEING a portion of the lands of D. & E. DEVELOPMENT, A PARTNERSHIP, as described in Deed recorded in Book D 261 at page 677, Official Records of Santa Clara County, and being a strip of land 20.00 feet in width, the centerline of which is more particularly described as follows: . "BEGINNING at a point in the easterly line of Kern Avenue distant thereon N. P24' 30"W. 122.40 feet from the intersection the reof wi th the northerly line of Tract No. 6184 as shown on the map thereof recorded in Book 407 of Maps at pages 25 and 26, Records of Santa Clara County, California, and running thence along the centerline of said easement N. 71 044 I 14"E. 369.85feet and N. 86005' E. 51 . 26 feet to a point in the easterly line of said Lands conveyed to D. & E. Development, distant thereon N.4028'W. 106.08 feet from an angle point in the northerly line of Lot 15 in said Tract No. 6184". Parcel Two A temporary construction easement 50 feet in width, the southerly line of which is the northerly line of Parcel One above described, and extending the full length thereof. Said temporary easement is to be considered abandoned and will be null and void upon completion of construction of the sanitary sewer to be constructed through Parcel One, above described, and acceptance of the work by the City of Gilroy.
