THIS INDENTURE, Made this 13th day of June, 1961, between GILROY
r(-1t-
ELEMENTARY SCHOOL DISTRICT, of the County of Santa Clara, State of California,
Party of the First Part and CITY OF GILROY, a Municipal Corporation in the
County of Santa Clara of said State, the Party of the Second Part;

That for and in consideration of the sum of ONE ($1.00) DOLLAR, cash
in hand paid, the receipt of which is hereby acknowledged, the party of the
first part has this day granted, bargained and sold, and by these presents
does grant, bargain, sell, convey, transfer and deliver unto the party of
the second part, a permanent easement and right of way for the installation
and maintenance of an underground sanitary sewer line and a storm drain
over, under, in, and across the following described premises located in the
County of Santa Clara, State of California to-wit:
"BEGINNING at the southeasterly corner of that certain 11.285
acre parcel of land as described in the Final Order of Condemnation
entered in the Superior Court of the State of California, in and
for the County of Santa Clara, entitled "Gilroy School District of
Santa Clara County, Plaintiff, vs. San Martin Vineyards Company, a
co-partnership, et aI, defendants, Case No. 116021, certified copy
of said order being filed for record on August 24, 1960 in Volume
4896 at page 254 of the Official Records of Santa Clara County, and
running thence along the southerly line of said 11.285 acre parcel
N. 890 10' 30" W. 30.00 feet; thence N. 00 46' 30" E. 886.03 feet;
thence along a curve to the left having a radius of 20.00 feet a
central angle of 1020 17' a distance of 35.70 feet to a point on a
compound curve; thence continuing along a curve to the left having
a radius of 960.00 feet and a central angle of 60 24' 50" a distance
of 107.47 feet to a point of reverse curve; thence along a curve to
the right with a radius of 1030.00 feet a central angle of 180 41'
50" a distance of 336.12 feet; thence N. 890 13' 30" W. 137.97 feet;
thence N. 150 20'40flW.31.23 feet; thence S. 890 13' 30" E. 146.64
feet; thence along a curve to the left having a radius of 1000.00
feet and a central angle of 190 31' 30" a distance of 340.78 feet;
thence along a curve to the right having a radius of 1000.00 feet
and a central angle of 90 07' 30" for a distance of 159.26 feet;
thence S. 00 46' 30" W. 951.14 feet to the point of beginning."

including the perpetual right to enter upon the said easement land at any
time and construct, maintain, and repair an underground storm drain, and

also an underground sanitary sewer line for the purpose of conveying
sewage over, across, through, and under the lands hereinbefore described,
together with the right to excavate and refill ditches and/or trenches for
the location, placing, replacing and repair of said sewer and storm drain
lines, and the further right to remove trees, bushes, undergrowth, and
other obstructions, if any, interfering with the location, construction,
repair, and/or maintenance of said sewer lines and underground storm drain
lines.
IN WITNESS WHEREOF the Party of the First Part has caused this
indenture to be executed on its behalf by FLOYD EMERSON, District Super-
intendent of Schools of said Gilroy Elementary School District of Santa
Clara County, the Grantor herein, by virtue of a resolution duly and
regularly adopted by its Board of Trustees of said District at a meeting
duly and regularly held on the 13th day of June, 1961, at which a quorum
was present.

SCHOOL DISTRICT OF SANTA CLARA COUNTY described in and that executed the
within instrument, and also known to me to be the person who executed
the within instrument on behalf of the said GILROY ELEMENTARY SCHOOL
DISTRICT OF SANTA CLARA COUNTY therein named and he acknowledged to me
that said District executed the same, pursuant to a resolution of the
Board of Trustees of said District.

RESOLUTION NO. 628
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ACCEPTANCE OF CONVEY-
ANCE OF EASEMENT FOR RIGHT OF WAY FOR SANITARY SEWER LINE AND STORM
DRAIN EXECUTED BY GILROY ELEMENTARY SCHOOL DISTRICT.
BE IT RESOLVED by the Council of the City of Gilroy that said City
does hereby accept the attached conveyance by Gilroy Elementary
School District of Santa Clara County to the City of Gilroy of an
easement for right of way for a Sanitary Sewer line and for a Storm
Drain along the East and North boundary lines of the 11.285 acre tract
of land descdbed In the final order of condemnation made in the
action brought by Gilroy School District of Santa Clara County vs.
San Martin Vineyards by a co-partnership, In the Superior Court of
Santa Clara County, and of record In the office of the County Recorder
of Santa Clara County In Volume 4896 of official records at page 254,
and consents to Its recordation.
PASSED AND ADOPTED this 19th day of June, 1961, by the following vote:
