OF SEWER LINE
THIS INDENTURE, made this 1~/(day of september, 1961,
between GOTHARD GUERINI and ANNA GUERINI, his wife, parties of the
First Part, and the CITYOF GILROY, a municipal corporation in the
county of Santa Clara, in said State, the party of the Second Part;

Parties of the First Part, for and in consideration of the
sum of ONE ($1.00) DOLLAR, cash in hand, paid to the party of the
Second Part, a receipt hereby acknowledged by the parties of the
First Part, have this day granted, bargained and sold and by these
presents, do grant, bargain, sell, convey, transfer and deliver unto
the party of the Second Part a permanent easement and right-of-way
for the installation and maintenance of an underground sanitary sewer
line over, in, under, through and across the following described
premises located in the City of Gilroy, County of Santa Clara, State
of California, to-wit:
PARCEL I. A strip of land of a uniform width of 5 feet,
the southeasterly line of which is described as follows:
"BEGINNING at a point in the line common to Sublots 16
and 17 as shown on the Map, distant thereon S. 700 W.
47.72 feet from the corner common to Sublots 16 and 17,
as shown on the Map hereinafter referred to, in the
southwesterly line of Sublot 18, and running thence
along said common line, S. 700 W. 55.48 feet; and being
a portion of Sublot 16 as shown on Map No.8, filed with
the final report of the referees in the Las Animas Rancho
partition Suit, Action No. 5536, had in the Superior Court
of the State of California, in and for the County of Santa
Clara;"
Including the perpetual right to enter upon said easement
land at any time and construct, install, maintain and repair an
underground sanitary sewer line for the purpose of conveying sewage

over, across,
through and under the lands hereinbefore described,
for the location, placing, replacing, maintenance and repairing of
said sewer line and the further right to remove trees, bushes, under-
growth and other obstructions, if any, interfering with the location,

constructiop, installation, repair and or maintenance of said sewer
line.
The said easement above described is hereby granted to the
party of the Second Part upon the condition that the parties of the
First Part, their heirs, successors and assigns shall have the right
to make one house service connection with the said sewer line, when
the same is installed, without the payment of any fee or service
charge to the city of Gilroy; but the cost of connecting the line or
lateral 3nd of the installation thereof shall be born by the First
Parties, their heirs, successors or assigns. The foregoing condition
shall be a covenant running with the land.
IN WITNESS WHEREOF, the parties of the First Part have
hereunto set their hands the day and year first hereinabove written.
