Jerry D. Moen and Dorothy L. Moen (collectively, "Moens"), the
owners of that certain real property defined below as Parcel 2,
on behalf of themselves and their successors and/or assigns,
hereby acknowledge and agree for the benefit of the City of
Gilroy ("City") as follows:
That certain Parcel 2 ("Parcel 2") comprising approximately
19,820 square feet, located at the northwest corner of
Princevalle Street and Georgetown Place, Gilroy, CAlifornia, as
shown on that certain parcel map prepared by Garcia & Henry,
Inc., Civil Engineers, entitled "A Subdivision of Parcel 4, 626
Maps 17, Santa Clara County Records in the City of Gilroy, County
of Santa Clara, California" recorded in the Official Records of
Santa Clara County of even date herewith, and consisting of a
portion of that certain Parcel 4 as shown on that certain map
(the "Parcel Map") recorded on May 28, 1991 in Book 626 of Maps
at Page 17 in the Official Records of Santa Clara County, will
not be granted sewer allocation for three (3) years following the
date that the Parcel Map was recorded, and, at such later time,
only if infill sewer allocations are available.
Nothing contained herein precludes sewer allocations from being
granted to Parcel 2 at an earlier date as a result of application
and City approval in compliance with the City's Residential
Development Ordinance.
The acknowledgements and agreements contained herein shall run
with the land of Parcel 2, shall be binding upon the successors
and assigns of Moens and shall not be modified, nullified or
rescinded without the prior, written consent of the City.
