parties, hereby grant to CITY OF GILROY, a municipal corporation, the second
party, all that real property situated in the City of Gilroy, County of Santa
Clara, State of California, described as follows:
A right of way over a strip of land five (5) feet wide being
a portion of Las Animas Ranch Lot No. 16 accordin~ to Map
No. 7 accompanying the report of the Referees in the Las
Animas Rancho Partition Suit, Action No. 5536, had in the
Superior Court of the State of California, in and for the
County of Santa Clara, and 1!10re particularly described as
folloy[s:
The Northeasterly five (5) feet of Lot 16 as shown upon
Tract No. 165, "Sunset Parle" of record j,n Book 5 of [.Taps,
pages 28 and 29, records of Santa Clara County, California,
excepting the southeasterly five (5) feet of said Lot 16,
the intention being to incblde a strip of land of a
uniform Itlidth of five (5) feet along the northeasterly
bound8.J'v line of said Lot 16 from the nox.therly line
thereof down to the premises of William W. Deibel' and
Jessie M. Deiber.
This easement and right of way is granted to the party of the
so'cond part for the installation, maintenance and repair of Seyler lines,
water lines and other public utility lines over, under, on and in said
strip of land, all of which lines and utilities shall be laid, maintained
and repaired so as to interfere no more than is reasonably necessary with
the surface of the ground and the use thereof by the parties of the first
part, their heirs, successors, and assigns.
