DEDICATION FOR EMERGENCY ACCESS & UTILITY PURPOSES

The undersigned, being the legal owners of the real property hereinafter described,
hereby dedicate to public use an easement for public utilities and emergency access pur-
poses, including but not limited to electric, gas, telephone, cable TV, water, storm
drainage, sanitary sewers, etc., under, over, on and across the real property hereinafter
described.
The undersigned further irrevocably offers to dedicate to the City of Gilroy for use
of the public an easement for public utilities and emergency access purposes over, under,
on and across the real property hereinafter described, said dedication to be accepted only
when the City Council of the City of Gilroy adopts a resolution accepting said easement
and records this dedication in the office of the Recorder of the County of Santa Clara.
Until said easement is improved to City of Gilroy specifications and recorded, the City of
Gilroy shall "not be responsible for maintaining said right of way and improvements thereon.
If any change in change in alignment, length or width of right of way approved by the
City of Gilroy results in vacation of any part of the real property dedicaled herein, suCtl
vacation shall terminate the dedication as to the part vacated.
The provisions hereof shall inure to the benefit and be bind~ng upon the heirs, suc-
cessors, assigns and personal representatives of the respective parties hereto.
BEING a portion of the Solis Rancho in Santa Clara County, California as patented, and
being also a portion of that certain parcel of land conveyed to Seferino Joe Garcia and
Maria I. Garcia, his wife,as Joint Tenants, by Deed recorded in Book E 880 at page 91,
Official Records of Santa Clara County, California, and being more particularly describ-
ed as follows:
"HlGINNING at the southeasterly curner CJ r sa.iJ J-lan:el cunveyeJ lu Gan:iu, .in
the westerly line of Morey Avenue, and running thence along the southerly
line of said Parcel N.81010'38"W.207.50 feet to the southwesterly corner there-
of; thence along the westerly line thereof N.4056'E. 36.78 feet; thence along
a curve to the right with a radius of 82.50 feet, from a tangent bearing of S.
69029'13"E., through a central angle of 14023'30" for a distance of 20.72 feet;
thence parallel with the southerly line of said Parcel 5.81010'38"E. 188.40
feet to a point in the easterly line of said Parcel, being also the westerly
line of Morey Avenue; thence along said westerly line S.4056' W. 30.07 feet to
the point of beginning".

I, the City Administrator of the City of Gilroy, do hereby certify
that pursuant to the authority given by Resolution No. 83-55, adopted hy the
Council of the City of Gilroy on the 18th day of July, 1983, at a regular
meeting of said Council, a certified copy of which resolution is on record
in the office of the County Recorder of the County of Santa Clara, State of
California, in Book and Page 7755622, I, as said City Administrator, do hereby
accept on behalf of the said City the conveyance to the City of Gilroy by ___
