and interest in and to the real property situated in the City of Gilroy, County
of Santa Clara, State of California, described as follows:
BEGINNING at a point on the easterly line of Monterey Road, said
point being the northwesterly corner of the 0.50 acre parcel
described in the deed to Shell Company of California, recorded
May 16, 1921, in Book 536, page 105 of Deeds; thence North 210
25'0011 West along said easterly line, 150.25 feet; thence North
70000'0011 East, 7.25 feet to a line parallel with and distant
easterly, 54.00 feet from the centerline of said Monterey Road;
thence South 20000'0011 East along said parallel line, 140.00
feet to the beginning of a tangent curve concave northeasterly,
having a radius of 40.00 feet; thence southeasterly, easterly
and northeasterly along said curve through a central angle of
90000' 0011, an arc distance of 62.83 feet to a line parallel with
and distant northwesterly, 52.00 feet from the centerline of
Tenth Street; thence tangent to said curve North 70000'0011 East
along said parallel line, 123.69 feet to the westerly line of
the right of way of the Southern Pacific Railroad Company; thence
South 20000'0011 East along said westerly line, 9.00 feet to the
northwesterly line of Tenth Street; thence South 70000'0011 West
along said northwesterly line, 146.75 feet to the beginning of
a tangent curve concave northeasterly, having a radius of 20.00
feet; thence southwesterly, westerly and northwesterly along
said curve through a central angle of 8S035'001l, an arc distance
of 31.08 feet to said easterly line of Monterey Road; thence
tangent to said curve North 21025'0011 Hest, 19.30 feet to the
Point of Beginning.
This grant is made and accepted on the express condition that said
parcel of land is to be used for public street purposes only. Should the said
City of Gilroy fail or discontinue to use said parcel of land for public street
purposes, or should said City of Gilroy use said parcel of land for any purpose other
than, or in addition to, public street purposes, then in any of such events, the
undersigned, their heirs and assigns forever shall have the power to terminate the
estate hereby granted by re-entry upon said parcel of land, and shall have the right
to enter said parcel of land and take and hold possession thereof free and clear of
the estate hereby granted.

No. 944, adopted by the Council of the City of Gilroy on the 6th
day of July, 1965, at a regular meeting of said Council, a certified
copy of which resolution is on record in the office of the County
Recorder of the County of Santa Clara, State of California, in Book
7027, page 228, I, as said City Administrator, do hereby accept on
