FCWLES nECO:~(DEn .."'> 5 -:-, ~ ::~ o NO FEE For valuable consideration, the receipt and sufficiency of which is hereby acknowledged, GULF OIL CORPORA TION, a Delaware corporation with offices. at 1801 Avenue of the Stars, Los Angeles, California 90067, hereinafter referred to as "Grantor", does hereby grant, bargain, sell and convey to the City of Gilroy , a body corporate and politic of the State of California -, hereinafter called "Grantee", for public street and road pur,poses all of Grantor's right, title and interest in and to the surface and top five hundred (500) feet of subsurface of the following described real property in the City of Gilroy , County of Santa Clara ,State of California BEGINNING at the point of intersection of the Northeasterly line of Murray Avenue (60.00 feet in width), with the Southeasterly line of Leaves1ey Road, as said line was establish ed by Deed from Hazel A. Shy, a widow to the County of Santa Clara, dated November ~5, 1963 recorded January 30, 1964 in Book 6366 Official Records, page 741, Santa Clara County Records; thence from said point of beginning North 640 40' East along said Southeasterly line of Leavesley Road for a distance of66.69 feet to a point of cusp; thence Southwesterly along an arc of a curve to the left, from a tangent bearing South 640 40' West, with a radius of 40.00 feet, through a central angle of 90059', for an arc distance of 63.52 feet to a point in a line which is parallel with and distant Northeasterly 26.00 fe~t at right angles from the said Northeasterly line of Murray Avenue; thence South 26019' East along said parallel line for a distance of134.31 feet; thence South 640 40' West and parallel with the said Southeasterly line of Leaves1ey Road for a distance of 26.00 feet to a point in the said Northeasterly line of Murray Avenue; thence North 260 19' West along said last mentioned line for a distance of 175.00 feet to the point of beginuing. Lr'"l"". i' I t 1.L\u BY excepting and reserving, however, to Grantor all of Grantor's right, title and interest in and to that portion of the land described above situated more than five .hundred (500) feet below the surface thereof, specifically including the right to explore, dril~ for, produce, extract, treat, remove and market oil, gas and other minerals therefrom but without any right to enter upon or to uti- lize'the surface of the land herein described or any part thereof above the depth of five hundred (500) feet below the surface. ~ .. CERTIFICATE OF ACCEPTANCE OF CONVEYANCE TO THE CITY OF GILROY BY GULF OIL CORPORATION I, the City Administrator of the City of Gilroy, do hereby certify that pursuant to the authority given by Resolution No. 944, adopted by the Council of the City of Gilroy on the 6th day of July, 1965, at a regular meeting of said Council, a certified copy of which resolution is on record in the office of the County Recorder of the County of Santa Clara, State of California, in Book 7027, page 228, I, as said City Administrator, do hereby accept on behalf of the said I City the conveyance to the City of Gilroy by Gulf Oil Corporation of the premises described in the attached conveyance dated the 21st November 1969 , and day of , that the said City of Gilroy consents to the recordation of said con- veyance.
