Sec. 6 SPACE ABOVE THIS LINE FOR RECORDER'S USE Document No.: 2 Project: 152B Highway Improvement Project APN: 841-17-005 & 091 MAINTENANCE EASEMENT DEED ConAgra Foods Packaged Foods Company, Inc, a Delaware corporation, herein referred to as "Grantor," grants to the Santa Clara Valley Transportation Authority and its successors and assignees hereafter referred to as "VT A," an easement for maintenance of the traffic signal loops located at the entry way of 1350 Pacheco Pass Highway (Highway 152), inclusive of ingress egress rights, the right to construct, replace, remove and maintain over, upon and across a portion of that real property in the City of Gilroy, County of Santa Clara, State of California, described as: See Exhibit "A" attached hereto and made a part hereof, which description by this reference is incorporated herein. Except in case of an emergency, VT A shall provide Grantor forty-eight (48) hours notice prior to entering the Grantor's Property. In the case of an emergency, VT A shall notify Grantor as soon as reasonably practical prior to entering Grantor's Property. VTA agrees to repair any damage to the Grantor's Property as a result ofVTA exercising any of its rights under this Maintenance Easement. If the VT A discontinues operation of the traffic control loops on the Property for a period of more than one hundred and eighty (180) days, it shall execute and record a quitclaim deed with respect to this Maintenance Easement upon request of Grantor.
