JOSEPH A. McCARTHY AND MURIEL M. HARRIS, as successor trustees of the
RIM Trust, a Revocable Trust dated February 12, 1982, as to an undivided one-
half (1/2) interest, and JOSEPH A. McCARTHY AND MURIEL M. HARRIS, as
successor Trustees of the MGM Trust, a Revocable Trust dated December 14,
1982,
does hereby grant to the City of Gilroy, a political subdivision of the State of
California, for the purpose of digging, constructing, reconstructing, repairing and
forever maintaining thereon, drainage pipelines of such dimensions as Grantee
shall deem necessary for drainage purposes, together with appurtenant
structures thereof, a drainage easement over that certain real property in the
City of Gilroy, State of California, bounded and described as follows, to wit:
SEE EXHIBIT A AND EXHIBIT B ATTACHED HERETO AND MADE A PART HEREOF
Together with the perpetual right and privilege of flowing water in, through, and
along said pipelines in such amounts and at such times as Grantee shall deem
necessary, and the perpetual right of ingress to and egress from said property,

A 20.00 foot wide strip of land, the centerline of which is described as follows:
ALL THAT REAL PROPERTY situated in the City of Gilroy, County of Santa Clara,
State of California and being apportion of "Parcell" as shown on that certain
parcel map filed for record in the Office of the Recorder of Santa Clara County on
April 4, 1997 in Book 686 of Maps, at Page 4~. More particularly described as
follows:
Commencing at a 314" iron pipe marking the Northwest corner of said "Parcell";
thence along the North line of said "Parcell", North 51048' 38" East, 406.94
feet to the true point of beginning of this description; thence from said point of
beginning, South 310 27' 02" East, 914.00 feet more or less to a point in the
Princevalle channel.
Together with and including thereto, temporary working easements 25.00 feet in
width on each side of the above described ed 20.00 foot wide strip of land. Said
temporary easement shall terminate upon installation and acceptance of the
storm drain facilities by the City of Gilroy.

This is to certify that the interest in real property conveyed by the easement for drainage
canal, ditch or pipeline dated March 3,2003 from Joseph A. McCarthy and Muriel M. Harris, as
successor trustees ofthe RIM Trust, a Revocable Trust dated February 12, 1982, as to an
undivided one-half (1/2) interest, and Joseph A. McCarthy and Muriel M. Harris, as successor
Trustees ofthe MGM Trust, a Revocable Trust dated December 14, 1982, to the City of Gilroy, a
municipal corporation of the State of California, is hereby accepted by the undersigned officer or
agent on behalf of the City of Gilroy pursuant to authority conferred by Resolution No. 99-90 of
the City of Gilroy adopted December 20, 1999, a certified copy of which resolution is on record
in the office of the County Recorder of the County of Santa Clara, State of California, document
