RESOLUTION NO. 78-8
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DETERMINING
SCHOOL IMPACTION AND FIXING FEES.
WHEREAS, an application and notice of findings has heretofore
been filed by the GILROY UNIFIED SCHOOL DISTRICT requesting a continuation
of the declaration of impaction under the provisions of Gilroy Ordinance
No. 77-25, and the provisions of Chapter 4.7, Division 1 of Title 7
of the Government Code and Gilroy Ordinance No. 77-41, and
WHEREAS, the Council of the City of Gilroy fixed January 16, 1978,
at 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390
Rosanna Street, Gilroy, California, as the time and place for a public
hearing on said application, and said hearing has been held and continued
to this date;
The Council does hereby find from the evidence submitted with the
application and testimony given at the hearing that:
1. Conditions of overcrowding exist and have existed
since before October 17, 1977, and the Council does concur in the
findings of the Board of Education of the Gilroy Unified School
District in its Resolution dated September 12, 1977, which the
Board readopted on January 27, 1978;
2. The conditions of overcrowding will continue at least
until September 1, 1978j
3. The fees to be paid of $480.82 for a single family
residence and $228.11 for a multiple residence unit or mobile
home bear a reasonable relationship to the interim needs for
school facilities caused by current development.
4. All other conditions of Government Code section 65974
are satisfied.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Gilroy
that all schools in the Gilroy Unified School District continue to be

impacted at least until September 1, 1978, under the provisions of
Ordinance No. 77-25, and the provisions of Chapter 4.7, Division 1 of
Title 7 of the Government Code and Gilroy Ordinance No. 77-41, and
collection by the GILROY UNIFIED SCHOOL DISTRICT of the fees set forth
above at the time a building permit is issued is hereby approved~ subject
to the requirements of Government Code sections 65976 and 65978.
