RESOLUTION NO. 78-23
A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES
OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN
UNINHABITED TERRITORY DESIGNATED AS "HECKER PASS ANNEXATION
77-9 TO THE CITY OF GILROY"
WHEREAS, a written petition has been filed in the office of the
City Clerk of the City of Gilroy in accordance with the provisions of
the "Municipal Organization Act of 1977", asking that there be annexed
to the City of Gilroy certain uninhabited territory located in the
County of Santa Clara, State of California, hereinafter more particularly
described; and
WHEREAS, said petition has been signed and consented to by the
owners of all of the land in the territory proposed to be annexed and
said territory is contiguous to the City of Gilroy; and
WHEREAS, an application for annexation of the said premises has
been filed with the Santa Clara County Local Agency Formation Commission,
and said Commission did make its determination upon the proposed annexation,
and has approved and authorized said annexation as proposed pursuant to
section 35157 of the Government Code; and
WHEREAS, pursuant to Section 35151 of the Government Code the
territory is to be annexed without notice and hearing, and without an
election.
NOW. THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY
AS FOLLOWS:
Section I: Under the authority of the said "Municipal Organization
Act of 1977", and Section 35221 of the Government Code of the State of
California, there is hereby annexed to the City of Gilroy the uninhabited
territory particularly described as follows:
BEING all of Lot 3 and a portion of Lot 4 and Hecker Pass High-
way (Bodfish Mill Road) as shown upon that certain map entitled,
"Map of the Subdivision of the Land of S. P. Fine in the Solis

"Rancho, Santa Clara County, California," which map is filed
for record in the Office of the Recorder of the County of
Santa Clara, State of California, on December 2. 1909 in
Volume "F-2" of Maps' at page 46, and being more particularly
described as follows:
BEGINNING at the southerly common corner to Lots 3 and 4 as
shown on Map and running thence along the line common to said
Lots N.4030'E. 2190.94 feet to the southwesterly corner of that
certain 5.00 acre parcel of land conveyed by Leonides Fine and
E. R. Doyle by Deed recorded May 12, 1914 in Volume 413 of Deeds
at page 558; thence along the southerly line of said 5.00 acre
parcel N.88045'E. 219.98 feet to the southeasterly corner there-
of; thence along the easterly line thereof N.4030'E. 991.58 feet
to the northeasterly corner thereof in the southerly line of
the Hecker Pass Highway (formerly Bodfish Mill Road) from which
the northerly common corner to said Lots 3 and 4 bears S.88045'W.
219.98 feet; thence continuing on the prolongation of the easterly
line of said 5.00 acre parcel N.4030'E. 33.17 feet to the center
line of the Hecker Pass Highway; thence along the centerline of
the Hecker Pass Highway S.88045'W. 664.59 feet to the intersection
thereof with the prolongation of the westerly line of Lot 3 as
shown on said map; thence along said prolongation and westerly
line of Lot 3 S.4030'W. 3087.92 feet to the southwesterly corner
thereof; thence alon? the southerly line of Lot 3 S.86045'E. 229.73
feet; thence S.61055 E. 233.57 feet to the point of beginning.
and
CONTAINING THEREIN 37.028 acres of land. ~I~
Section II: The said territory hereby annexed to the City of
Gilroy is hereby designated as "HECKER PASS ANNEXATION 77-9 TO THE CITY
OF G ILROY1' .
Section III: This annexation shall take effect on the date of the
recordation of a certified copy of the certificate of completion with the
county recorder pursuant to Section 35354 of the Government Code.
PASSED AND ADOPTED this 20th day of March, 1978, by the following
