RESOLUTION NO. 78-33
RESOLUTION OF INTENTION TO VACATE THE SOUTHERLY 170 FEET
OF THE PUBLIC ALLEY FROM FIRST STREET TO SECOND STREET
BETWEEN MONTEREY AND EIGLEBERRY STREETS, RESERVING TO THE
CITY EASEMENTS FOR ALL PUBLIC FACILITIES.
WHEREAS, the alley from First Street to Second Street between
Monterey and Eigleberry Streets in the City of Gilroy is one of the
public alleys in said city, and the southerly 170 feet thereof is
unneces~ary for present or prospective public street purposes and
should be vacated. but that public convenience and necessity require
the reservation of easements for all public facilities;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Gilroy that it does hereby declare its intention to vacate the southerly
170 feet of the alley from First Street to Second Street between
Monterey and Eigleberry Streets, reserving to the City all easements
for public facilities set forth in Streets and Highways Code section
8330;
BE IT FURTHER RESOLVED that this Resolution shall be published
and said alley posted as required in the Street Vacation Act of 1941,
under which this proceeding is instituted, and the 5th day of July,
1978, at 8:00 o'clock p.m., in the Council Chambers, City Hall, 7390
Rosanna Street, Gilroy, California, is hereby designated as the time
and place at which said City Council shall hear any and all persons
interested in or who may object to the proposed vacation.
One publication of said notice shall be made in the Gilroy
Dispatch, a newspaper published in the City of Gilroy, at a date at

at least ten (10) days prior to the time of hearing.
