RESOLUTION NO, 78-37
RESOLUTION OF INTENTION TO VACATE A 37.5 FOOT WIDE STRIP
OF LAND ON THE WEST SIDE OF FOREST STP~ET RUNNING 206
FEET SOUTH FROM THE SOUTH SIDE OF LEAVESLEY ROAD, RESERVING
TO THE CITY EASEMENTS FOR ALL PUBLIC FACILITIES.
WHEREAS, Forest Street in the City of Gilroy. is one of the
public streets in said city and a 37,5 foot wide strip of land on
the west side of Forest Street running 206 feet south from the
south side of Leavesley Road, except for a return area with a 30
foot radius at the southwest corner of Forest Street and Leavesley
Road, is unnecessary for present or prospective public street
purposes and should be vacated, but that public convenience and
necessity require the reservation of easements for all public
facilitiesj
NOW, THEREFORE. BE IT RESOLVED by the Council of the City of
Gilroy that it does hereby declare its intention to vacate a 37.5
foot wide strip of land on the west side of Forest Street running
206 feet south from the south side of Leavesley Road, except for a
return area with a 30 foot radius at the southwest corner of Forest
Street and Leavesley Road. reserving to the City all easements for
public facilities set forth in Streets and Highways Code section 8330;
BE IT FURTHER RESOLVED that this Resolution shall be published
and said street posted as required in the Street Vacation Act of 1941,
under which this proceeding is instituted, and the 5th day of July,
1978, at 8:00 o'clock p.m., in the Council Chambers, City Hall, 7390
Rosanna Street, Gilroy, California, is hereby designated as the time
and place at which said City Council shall hear any and all persons
interested in or who may object to the proposed vacation.
One publication of said notice shall be made in the Gilroy DispBt;~,
a newspaper published in the City of Gilroy, at a date at leas~ cell
(10) days prior to the time of hearing.
