RESOLUTION NO, 78-53
A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE
BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION
THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED
AS "MURRAY AVENUE ANNEXATION 78-3 TO THE CITY OF
GILROY"
WHEREAS, a written petition has been filed in the office of the
City Clerk of the City of Gilroy in accordance with the provisions of
the "Municipal Organization Act of 1977", asking that there be annexed
to the City of Gilroy certain uninhabited territory located in the
County of Santa Clara, State of California, hereinafter more particularly
described; and
WHEREAS, said petition has been signed and consented to by the
owners of all of the land in the territory proposed to be annexed and
said territory is contiguous to the City of Gilroy; and
WHE~S, an application for annexation of the said premises has
been filed with the Santa Clara County Local Agency Formation Commission,
and said Commission did make its determination upon the proposed
annexation, and has approved and authorized said annexation as proposed
pursuant to section 35157 of the Government Code; and
WHEREAS, pursuant to Section 35151 of the Government Code the
territory is to be annexed without notice and hearing, and without an
election.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY
AS FOLLOWS:
Section I: Under the authority of the said "Municipal Organization
Act of 1977", and Section 35221 of the Government Code of the State of
California, there is hereby annexed to the City of Gilroy the uninhabited
territory particularly described as follows:
Being a portion of Lots 3 and 4 as shown on "Map of the
Subdivision of the Southerly Portion of Las Animas Ranch

Lot 34 and Sub Lot 2", said map is filed for record
in Book M o~ maps at page 79, Records ot Santa Clara
County, Cali~ornia, and being more particularly described
as follows:
BEGINNING at the point of intersection of the Westerly line
of Murray Avenue and the line common to Lots 4 and 5, as
ShOWll on said map, said point also being the most Northerly
corner of the "Murray Avenue Annexation 76-7" to the City
of Gilroy as described in Ordinance No. 77-5 ot the City of
Gilroy adopted February 7, 1977; thence along the existing
corporate limits of the City of Gilroy as described in said
"Murray Avenue Annexation 76-7", also being the line common
to said Lots 4 and 5, S 670 40' 00" W 792.00 feet; thence
along the Westerly line of said Lots 3 and 4, N22(1 20' OO"W,
528.00 feet to the intersection with the line common to Lots
2 and 3 as shown on said map; thence along the line common
to said Lots 2 and 3, N 670 40' 00" E, 792.00 feet to the
point of intersection ,vith the existing corporate limits of
the City of Gilroy as described in the "Murray Avenue No.1
Annexation 7l-8" to the City of Gilroy, Ordinance No. 953 of
the City of Gilroy adopted April 17, 1972, also being the
Westerly line of Murray Avenue as shown on said map; thence
along said existing corporate limits and said Westerly line
of Murray Avenue S 220 20' 00" E 528.00 ~eet to the point of
beginning.

Section II: The said territory hereby annexed to the City of
Gilroy is hereby designated as "MURRAY AVENUE ANNEXATION 78-3 TO THE
CITY OF GILROY".
Section III: This annexation shall take e~fect on the date of the
recordation of a certified copy of the certificate of completion with
the county recorder pursuant to Section 35354 of the Government Code.
