RESOLUTION NO. 78- 58
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY WITHDRAWING FROM
THE GILROY RURAL FIRE DISTRICT TERRITORY THEREIN RECENTLY ANNEXED
TO THE CITY OF GILROY UNDER THE DESIGNATION "LEAVESLEY NO. 3 AN-
NEXATION 78-1 TO THE CITY OF GILROY".
August
WHEREAS, there has heretofore and on the 7th day of
, 1978 been annexed to the City of Gilroy, under the
designation of "LEAVESLEY NO. 3 ANNEXATION 78-1 TO THE CITY OF
GILROY" the following described property located in the County of
Santa Clara, State of California to wit:
BEGINNING at the southwesterly corner of that certain
Parcel "A" as said 'Darcel is shown on that certain
Record of Survey filed for Record in the Office of the
County Recorder of Santa Clara County California on
May 21, 1963 in Book 161 of Maps at Page 33 therein;
said point of beginning being also the point of inter-
section of the southerly line of Leavesley Road with
the City of Gilroy corporate city limits line;
THENCE along said southerly line of Leavesley Road
(being also the southerly boundary of the Whitehurst
Annexation 69-1, annexed to the City of Gilroy by
Ordinance No. 863) N. 650 18' 08" E., 469.62 feet;
N. 240 41' 52" W., 50.00 feet and N. 650 18" 08" E.,
833.25 feet to the 'Doint of intersection with the
easterly line of Lot 1 as shown upon that certain
map entitled, "Map of the subdivision of the Eliza-
beth H. Martin Tract, being part of the John Gilroy
Portion of the Rancho San Ysidro", which map was
filed for record in the office of the said County
Recorder on October 2, 1894 in Book F of Maps at-
page 31 therein; thence along said easterly line of
Lot 1, S.310 27' 52" E., 4183.74 feet to the south-
easterly corner of said Lot 1;
THENCE along the southerly line of said Lot l~ S. 580
15' 14" W., 1890.89 feet more or less to the south-
westerly corner of said Lot 1; thence along the wes-
terly line of said Lot 1, N. 310 27' 52" E., 182.82
feet to the southeasterly corner of Sub Lot 10 and
Ranch Lot Number 38, as shown upon Maps Number 7 and
8 accompanying the Report of the Referees in the Par-
tition Suit of Henry Miller et al vs. Massey Thomas
et ai, had in the Superior Court of the State of
California in and for the County of Santa Clara;
THENCE along the southerly line of said Sub Lot 10
and its westerly prolongation S. 560 47' 26" ~J. ,
296.75 feet more or less to the point of intersection

with said City of Gilroy Corporate City Limits Line;
THENCE along said Corporate City Limits N. 190 16' 38"
W., 4208.67 feet more or less to point of beginning and
CONTAINING THEREIN 170.872 acres of land more or less,
and
WHEREAS, said premises so annexed to the City of Gilroy
were at the time of such annexation, included in and formed a part of
the Gilroy Rural Fire District, and the Council of the City of Gil-
roy desires that said territory so annexed be withdrawn from said
fire protection district.
NOW, THEREFORE BE IT RESOLVED, that said territory herein-
before described and so annexed to the City of Gilroy as "LEAVESLEY
NO. 3 ANNEXATION 78-1 TO THE CITY OF GILROY" be and the same is
hereby withdrawn from said Gilroy Rural Fire District.
