Resolution 1978-72 '" . . RESOLUTION NO. 78-72 A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS "TENTH STREET l\NNEXATION NO. 78-2 TO THE CITY OF GILROY" WHEREAS, a written petition has been filed in the office of the City Clerk of the City of Gilroy in accordance with the provisions of the "Municipal Organization Act of 1977", asking that there be annexed . to the City of Gilroy certain uninhabited territory located in the County of Santa Clara, State of California, hereinafter more particularly described; and WHEREAS, said petition has been signed and consented to by the owners of all of the land in the territory proposed to be annexed and said territory is contiguous to the City of Gilroy; and WlIEREAS, an application for annexation of the said premises has been filed with the Santa Clara County Local Agency Formation Commission, and said Commission did make its determination upon the proposed annexation, and has approved and authorized said ann~xation as proposed pursuant to section 35157 of the Government Codej and m{EREAS, pursuant to Section 35151 of the Government Code the territory is to be annexed without notice and hearing, and without an election. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY AS FOLLOWS: Section I: Under the authority of the said "Municipal Organization Act of 197711, and Section 35221 of the Government Code of the State of California, there is hereby annexed to the City of Gilroy the uninhabited territory particularly described as follows: Beginning at the point of intersection of the easterly line of South Chestnut Street (44 feet wide) with the dividing -1- RESOLUTION NO. 78-72 e . line between Las Animas Ranch Lots 44 and 45, as said lots are shown upon the maps accompanying the final Report of the Referees in the Patition Action of Henry Miller, et al vs. Massey Thomas, et al in the Superior Court of the State of California in and for the County of Santa Clara, Case 5536j thence along the northerly line of Ranch Lots 45 and 46 (being also the northerly line of the existing Gilroy City limits as established by South Chestnut Street Annexation 77-1 adopted by the City Council by ordinance 77-l9-S89010' 48"E, 1045.57 feet to the point of intersection with the westerly right of way of the South Valley Freeway (State High- way 101); thence along said westerly right of way line the following courses and distances: northerly along a curve to the left, with a radius of 2930.00 feet; through a central angle of 6022122" for an arc distance of 325.89 feet to a point of compound curvature; thence along a tangent curve to the left with a radius of 430.~O feet through a central angle of 450441 06" for an arc distance of 343.24 feet; thence N530l4'57"W, 402.50 feet; thence along a tangent curve to the left with a radius of 150.00 feet, through a central angle of 24024'43" for an arc distance of 63.91 feet to the point of intersection with the southeasterly line of the existing city limits as e established by the Tenth Street annexation 70-1 adopted by ordinance 884; thence along the boundary of said Tenth Street annexation 70-1, S25040'2411W, 224.42 feet; S700l~0'24"W, 200.00 feet and N19019'36"W 192.00 feet to the point of intersection with the original Gilroy City limits line; thence along said original Gilroy City limits line S70040'2411W, 205.50 feet to the point of intersection with a 40 foot radius curve concave southeasterly; said curve being the city limits line as estab- lished by the South Chestnut Street annexation 73-1 adopted by ordinance 980; thence continuing along last said city limits line along said curve deflecting to the left from a tangent bearing of S23 048' 15"W through a central angle of 53007 151 I' an arc length of 37.09 feet to a point on the easterly line of said South Chestnut Street (86' wide); thence along the easterly line of said South Chestnut Street (being the existing city limits as established by said South Chestnut Street annexation 73-1) the following courses and distances: S19019' 3611E, ll1.57 feet; S70040'24"W. 21.00 feet; thence along the arc of a 822 foot tangent curve to the right from a tangent bearing of S190l9'36"E, through a central angle of l6056'09" an arc distance of 242.97 feet and S2023'27"E. 324.83 feet to the point of beginning and containing 16.681 acres of land more or less. c.k/ I_il/l Section II: The said territory hereby annexed to the City of Gilroy is hereby designated as "TENTH STREET ANNEXATION NO. 78-2 TO THE CITY OF GILROY".
