RESOLUTION NO. 78- 73
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY WITHDRAWING FROM THE
GILROY RUP~L FIRE DISTRICT TERRITORY THEREIN RECENTLY ANNEXED TO THE
CITY OF GILROY UNDER THE DESIGNATION "TENTH STREET ANNEXATION 78-2
TO THE CITY OF GILROY".
WHEREAS, there has heretofore and on the 18th day of
September, 1978 been annexed to the City of Gilroy, under the desig-
nation of "TENTH STREET ANNEXATION 78-2 TO THE CITY OF GILROY" the
following described property located in the County of Santa Clara,
State of California to wit:
BEGINNING at the point of intersection of the easterly line
of South Chestnut Street (44 feet wide) with the dividing
line between Las Animas Ranch Lot 44 and 45, as said lots
are shown upon the maps accompanying the final Report of
the Referees in the Partition Action of Henry Miller, et
al vs. Massey Thomas, et al in the Superior Court of the
State of California in and for the County of Santa Clara,
Case 5536; thence along the northerly li~e of Ranch Lots
45 and 46 (being also the northerly line of the existing
Gilroy City Limits as established by South Chestnut Street
Annexation 77-1 adopted by the City Council by Ordinance
77-19, S. 89010' 48" E., 1045.57 feet to the point of
intersection with the westerly right of way of-the South
Valley Freeway (State Highway 101); thence along said
westerly right of way line the following courses and
distances:
northerly along a curve to the left, with a radius
of 2930.00 feet; through a central angle of 60 22'
22" for an arc distance of 325.89 feet to a point
of compound curvature; thence along a tangent curve
to the left with a radius of 430.00 feet through a
central angel of 450 44' 06" for an arc distance of
343.24 feet; thence N. 530 14' 57" l'l., 402.50 feet;
thence along a tangent curve to the left with a
radius of 150.00 feet, through a central angel of 240
24' 43" for an arc distance of 63.91 feet to the
point of intersection with the southeasterly line of
the existing city limits as established by the Tenth
Street Annexation 70-1 adopted by Ordiannce No. 884;
THENCE along the boundary of said Tenth Street Annexation
70-1, S. 250 40' 24" 1.v., 224.42 feet; S. 700 40' 24" W.,
200.00 feet and N. 190 19' 36" W. 192.00 feet to the point
of intersection with the original Gilroy City Limits line;
thence along said original Gilroy City Limits line S. 700
40' 24" 1.v., 205.50 feet to the point of intersection with
a 40 foot radius curve concave southeasterly; said curve
being the City Limits Line as established by the South
Chestnut Street Annexation 73-1 adopted by Ordinance No.

980; thence continuing along last said City Limits line
along said curve deflecting to the left from a tangent
bearing of S. 230 48' l5" W. through a central angle of
530 07' 51" an arc length of 37.09 feet to a point on
the easterly line of said South Chestnut Street (86'wide);
thence along the easterly line of said South Chestnut
Street (being the existing City Limits as established
by said South Chestnut Street Annexation 73-l) the fol-
lowing courses and distances:
S. 190 19' 36" E., 111.57 feet, S. 700 40' 24" W.,
21.00 feet; thence along the arc of a 822 foot
tangent curve to the right from a tangent bearing
of S. 190 19' 36" E., through a central angle of
160 56' 09" an arc distance of 242.97 feet and
S. 20 23' 27" E., 324.83 feet to the point of begin-
ning and
CONTAINING THEREIN 16.681 acres of land more or less,
and
WHEREAS, said premises so annexed to the City of Gilroy
were at the time of such annexation, included in and formed a part of
the Gilroy Rural Fire District, and the Council of the City of Gilroy
desires that said territory so annexed be withdrawn from said fire
protection district.
NOW, THEREFORE BE IT RESOLVED, that said territory herein-
before described and so annexed to the City of Gilroy as "TENTH STREET
ANNEY~TION 78-2 TO THE CITY OF GILROY: be and the same is hereby with-
drawn from said Gilroy Rural Fire District.
PASSED AND ADOPTED this 18th day of September, 1978, by
the following vote:
