RESOLUTION NO. 78.94
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
AFFIRMING ON APPEAL RESOLUTION NO. 78-52 OF THE
PLANNING COMMISSION GRANTING A ONE-YEAR NON-RENEWABLE
VARIANCE FOR AN OFF SITE PROJECTING SIGN, AND GRANTING
AN ALTERNATE VARIANCE FOR AN OFF SITE ROOF SIGN, AT
7293 MONTEREY STREET
WHEREAS, KUO HSUAN CHANG, as owner of the PACHECO PASS MOTEL,
has filed an appeal in due form from Resolution No. 78-52 of the
Planning Commission of the City of Gilroy granting a one-year non-
renewable variance to allow an off-site advertising sign projecting
more than 12 inches into the public right-of-way at 7293 Monterey
Street, and notice of the hearing of said appeal has been given in
the manner required by law and the Zoning Ordinance of the City of
Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
December 4, 1978, at 8:00 p.m. in the Council Chambers in the City
Hall at 7390 Rosanna Street, Gilroy, California, and evidence was
submitted upon the said application and appeal from the findings of
the Planning Commission, the City Council findsi
(1) The findings of the Planning Commission are hereby approved;
and
(2) The Planning Commission did not err in granting the one-
year non-renewable variance; and
WHEREAS, the Council further finds:
(1) Special circumstances of hardship will continue to exist
for the appellant after the expiration of one year due to continued
rerouting of all traffic from his premises by reason of the freeway,
and
(2) Some permanent solution should be found which is accept-
able to neighboring businesses which object to projecting signs, and

(3) An off-~ite directional sign is justified in this
case
THEREFORE, BE IT RESOLVED that Resolution No. 78-52 of the
Planning Corrunission is hereby affirmed.
BE IT FURTHER RESOLVED that appellant is hereby granted an
alternate variance to install an off-site roof sign, of similar size
and design and acceptable to the Architectural and Site Approval
Committee, at the same location.
