RESOLU~ION NO. 78 - 96
A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF GILROY APPROVING AND
ADOPTING THE REGIST~~R OF VOTERS' CANVASS OF THE SPECIAL ML~ICIPAL
ELECTION AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF
GILROY ON NOVEMBER 7, 1978.
RESOLVED, by the City Council of the City of Gilroy, Calif-
nia, that
WHEREAS, by order of this Council a special municipal elec-
tion was held and conducted in the City of Gilroy and consolidated
with the State of California Primary Election on Tuesday, November 7,
1978 as required by law and the Charter of said City as amended;
WHEREAS, it appears that notice of said election was duly
and legally given; voting precincts were properly established; elec-
tion officers were appointed and election supplies furnished; and
in all respects the election was held and conducted and the votes
cast thereat received and canvassed, and the returns thereof made,
determined and declared in time, form and manner as required by the
Charter of said City as amended and the general laws of the State
providing for and regulating municipal elections in said City;
WHEREAS, the Registrar of Voters did conduct the canvass
of the returns of said municipal election and did count the absentee
ballots cast thereat, Dursuant to direction and order of the City
Council of said City; and
WHEREAS, said canvass was duly completed and the results
thereof were certified by the Registrar of Voters and submitted to
this Council.
NOW, THEP~FORE, IT IS HEREBY RESOLVED AND ORDERED, as
follows:

1. Said municipal election was held and conducted in the
City of Gilroy, County of Santa Clara, State of California and con-
solicated with the State of California Primary Election held on
Tuesday, November 7, 1978 in the time and in the form and manner as
required by law.
2. That there were established eleven (11) voting precincts
for the purpose of holding said municipal election consisting of
regular election precincts established for holding state or county
elections as follows:
CONSOLIDATED PRECINCT NO. 3952, comprising state and
county precinct designated Precinct Number 3952 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3953, comprising state and
county precinct designated Precinct Number 3953 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3954, comprising state and
county precinct designated Precinct Number 3954 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3955, comprising state and
county precinct designated Precinct Number 3955 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3956, comprising state and
county precinct designated Precinct Number 3956 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PP~CINCT NO. 3959, comprising state and
county precinct designated Precinct Number 3959 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3960, comprising state and
county precinct designated Precinct Number 3960 as estab-
lished by the Santa Clara County Board of Supervisors.

CONSOLIDATED PRECINCT NO. 3961, comprising state and
county precinct designated Precinct Number 3961 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3964, comprising state and
county precinct designated Precinct Number 3964 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3966, comprising state and
county precinct designated Precinct Number 3966 as estab-
lished by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3969, comprising state and
county precinct designated Precinct Number 3969 as estab-
lished by the Santa Clara County Board of Supervisors.
3. The canvass of the returns of the votes cast and the
counting of absentee ballots cast in said City for Measure "G" was
duly held by the Registrar of Voters in accordance with the order
of the Council and in accordance with law and said Registrar of Voters
has executed a certificate certifying to the results of such canvass,
which certificate is hereto attached, marked Exhibit "A" and by this
reference is made a part hereof. Said certificate has been examined
and is hereby approved and adopted by this Council as the official
canvass of said municipal election.
4. The whole number of votes cast in said City of Gilroy
at said municipal election was 4,541 (including absentee votes).
5. The measure voted for, the number of votes received
in favor of and against said measure in each of said precincts and
by absentee votes, together with the whole number of votes which
said measure received in the entire city, are shown on said Exhibit
"A", hereto attached.

6. At said special municipal election held in the City of
Gilroy and consolidated with the State of California General Election
held on November 7, 1978, the following measure was defeated:
Shall the Council of the City of Gilroy pursue as an excep-
tion to current City policy, with two owners of land adja-
cent to the Golf Course and their agents, the expansion of
the Gilroy Golf Course? Specifically, the adjacent two (2)
property owners have offered to provide at no cost to the
City of Gilroy an additional 100 acres of land, to expend
the funds necessary to add an additional nine (9) holes to
the existing Gilroy Golf Course and to reconstruct the
present nine (9) hole faciltty to provide a complete 18 hole
golf course. Further, these owners propose to provide an
additional $200,000.00 toward the construction of a new Club
House.
Owners are requesting that they be given the necessary ap-
provals to construct adjacent to the expanded Golf Course
maximum combined total of eight hundred (800) residential
units equally proportioned over an eight (8) year period,
or more years at the discretion of the City Council, com-
mencing in 1980.
7. That the City Clerk be, and she is hereby, instructed
to enter this resolution in full in the minutes of this Council as a
statement of the result of said special municipal election.
PASSED AND ADOPTED this 4th day of December, 1978, by the
following vote:
AYES: COUNCIL MEMBERS: CHILDERS, CUNNINGHAM, HUGHAN,
LINK, PATE, STOUT and GOODRICH.
NOES: COUNCIL MEMBERS: ~one

I, George A. Mann, Registrar of Voters and
Recorder of the County of Santa Clara, State of Cali-
fornia, do hereby certify that at the General Election
held on November 7, 1978 a Special Municipal Election,
consolidated therewith, was held in the City of Gilroy
for the purpose of submitting Measure G to the voters
of said City;
That the official canvass of the returns of
said election was conducted by the office of the Regis-
trar of Voters in accordance with the appropriate provi-
sions of the Elections Code of the State of California;
and
That hereto attached is a full, true and correct
statement of the votes cast as said Special Municipal Elec-
tion.
