A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY HEREBY SETTING FORTH A DEFINITION
OF AFFORDABLE RENTS FOR GILROY'S COMMUNITY
DEVELOPMENT BLOCK GRANT HOUSING
REHABILITATION PROJECTS
WHEREAS:
A. The City of Gilroy wishes to include rental units in its housing rehabilitation
projects that are funded through its Community Development Block Grant (CDBG) received
from the federal Department of Housing and Urban Development (HUD); and
B. HUD regulations require that in order to use its funds for rehabilitation of rental
properties, a jurisdiction must define, make public, and adopt affordable rents for its CDBG
funded housing rehabilitation programs.
IT IS NOW THEREFORE RESOLVED THAT:
1. The City of Gilroy shall adopt the following definition of affordable rents for its
Community Development Block Grant funded housing rehabilitation programs:
The rent of the unit to be rehabilitated cannot exceed the rents for the 50% income level
as published by the California Tax Credit Allocation Committee (CTCAC) for the year in which
the rehabilitation takes place; or
The unit to be rehabilitated is one that is subsidized through a program operated by the
Housing Authority of Santa Clara County such as the Section 8 Housing Choice Voucher
Program and Project -Based Rental Assistance in which subsidies are used to ensure that the
tenants' share of rent is affordable; and
To be consistent with HUD regulations in multi -unit rental properties at least 51% of the
units shall meet the City's adopted definition of affordable rents before any of the units may be
rehabilitated through the use of CDBG funds.
