American Fire System, Inc. /~0L .' AGREEMENT THIS AGREEMENT, made the first day o~ April , 1987 in the City of Gilroy, County of Santa Clara, State of California, by and between the CITY OF GILROY, Gilroy, California, acting through and by its City Council, hereinafter called the CITY, and AMERICAN FIRE SYSTEMS, INC. hereinafter called the CONTRACTOR, WITNESSETH that the City and the Contractor for the considerations stated herein agree as follows: ARTICLE 1 - SCOPE OF WORK. The Contractor shall perform within the time stipulated the contract as herein defined, and shall provide all labor, materials, tools, utility services, and transportation to complete in a workmanlike manner all of the work required in connection with the following titled project: ADDITION TO GILROY HEADQUARTERS FIRE STATION In strict compliance with the contract documents as specified in Article 4 below. ARTICLE 2 - TIME FOR COMPLETION. The work shall be commenced on the date stated in the Owner's notice to proceed, as provided in the Instructions to Bidders, and as specified therein, shall be completed within One Hundred Fifty (150) calendar days from and after the date stated in such notice. ARTICLE 3 - CONTRACT PRICE. The Owner shall pay to the contractor as full consideration for the faithful performance of the contract, subject to any additions or deductions as provided in the contract documents, the sum of Twenty-Eight Thousand Two Hundred and no/lOa Dollars (S 28,200.00 said sum being the total amount of the following amounts stipulated in the proposal: as modified by letter from Contractor to Gilroy Fire Department dated March 24, 1987. ARTICLE 4 - COMPONENT PARTS OF THE CONTRACT. The contract entered into by this Agreement consists of the following contract ?ocuments. all of which are component parts of the contract as if herein set out in full or attached hereto: Invitation for Bids Proposal, as accepted Instructions to Bidders and Bid Bond Contractor's Certificate of Workmen's Compensation This Agreement Performance Bond Certificates of Insurance General Conditions and Special Conditions Agreement project 8614 Page 1 Specifications dated 10 December 1986 Addenda Nos.. (none) , as issued Drawings Sheets A-1, A-2 and M/E dated 10 December 1986 All of the above named contract documents are intended to be complementary. Work required by one of the above named contract documents and not by others shall be done as if required by all. "Every employer except the State shall secure the payment of compensation ln one or more of the following ways: (a) By being insured against liability to pay compensation in one or more insurers duly authorized to write compen- sation insurance in this state. (b) By securing from the Director of Industrial Rela- tions a certificate of consent to self-insure, which may be given upon furnishing proof satisfactory to the Director of Industrial Relations of ability to self-insure and to pay any 'compensation that may become due to his employees.
