A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY EXTENDING CHAPTER 6, ARTICLE VI OF
THE GILROY CITY CODE ENTITLED " UNREINFORCED
MASONRY BUILDING (URM) ORDINANCE" TO
COMPLETE THE SEISMIC SAFETY RETROFITTING
PROGRAM FOR UNREINFORCED MASONRY
BUILDINGS TO DECEMBER 16, 2013
WHEREAS, on October 16, 2006, the City Council adopted Ordinance No. 2006 -19,
which added Article VI entitled "Seismic Safety" to the Gilroy City Code effective on November
15, 2006, and set forth a deadline of three (3) years or until November 15, 2009, for completion
of retrofitting of Unreinforced Masonry ( "URM ") buildings and for the remedies and penalties in
Gilroy City Code sections 6.49 and 6.52 to take effect, which deadline was extended to
December 31, 2010 by Ordinance No. 2010 -15, and further extended to June 30, 2011 by
Resolution 2010 -65 ; and
WHEREAS, Chapter 6, Article VI of the Gilroy City Code was repealed in its entirety
on May 16, 2011 and replaced with a new Article VI of Chapter 6 entitled " Unreinforced
Masonry Building (URM) Ordinance"; and,
WHEREAS, this new Article was enacted to provide alternative construction regulations
designed to reduce the risk of death or injury resulting from earthquake hazards in existing
unreinforced masonry buildings in a timely and economically feasible manner while preserving
the historic character of the community; and,
WHEREAS, Article VI was adopted with an effective date of two (2) years, ending
June 15, 2013, and Section II of Article VI allows this date to be extended by resolution of the
City Council; and,
WHEREAS, staff has initiated a review of the success of the ordinance and recognizes
the need for additional time to complete the prescribed seismic safety retrofitting requirements as
identified in Chapter 6, Article VI.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
HEREBY RESOLVES to extend this deadline for six (6) months to December 16, 2013
PASSED AND ADOPTED by the City Council of the City of Gilroy on this 20`b day of
May, 2013, by the following roll call vote:
AYES: COUNCILMEMBERS: ARELLANO, AULMAN, BRACCO, LEORE-
MUNOZ, TUCKER, WOODWARD and GAGE
