A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF GILROY DISCONTINUING
PAYMENT AND REPORTING OF THE
EMPLOYER PAID MEMBER CONTRIBUTION
TO CALPERS FOR EXEMPT SAFETY
MANAGEMENT EMPLOYEES
WHEREAS, the governing body of the City of Gilroy has the authority to amend resolutions,
including Resolution No. 96 -72; and
WHEREAS, the governing body of the City of Gilroy has a written labor agreement which
specifically provides that the City of Gilroy will discontinue payment and reporting of the Employer
Paid Member Contributions (EPMC) for Exempt Safety Management employees effective July 1, 2013;
and
WHEREAS, one of the steps in the procedures to discontinue payment and reporting of the
EPMC pursuant to Government Code Section 20691 (formerly Government Code Sections 20023
(c)(4)) (pursuant to Government Code Section 20615) is the adoption by the governing body of the City
of Gilroy of a Resolution to discontinue said EPMC;
WHEREAS, the governing body of the City of Gilroy has identified the following conditions for
the purpose of its election to discontinue payment and reporting of EPMC:
• The discontinued benefit shall apply to all exempt safety management employees.
• Exempt safety management employees shall pay by salary deduction the 9% member
contribution.
• The effective date of this resolution shall be July 1, 2013.
WHEREAS, Resolution 96 -72 is amended as set forth above for exempt safety management
employees.

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY
OF GILROY hereby elects to discontinue payment and reporting of the Employer Paid Member
Contribution (EPMC), as set forth above for exempt safety management employees.
