City Council Meeting Minutes
February 24. 2014

A. Call to Order
Mayor Gage called the meeting to order at 6:00 p.m.
The pledge of allegiance was led by Council Member Tucker.
The invocation was given by Ruth Brenton of the Bahai Faith Community.
City Clerk Shawna Freels announced that the agenda had been posted on February 19,
2014 at 10:15 a.m.

II. CEREMONIAL ITEMS
A. Proclamations, Awards and Presentations
Mayor Gage presented a Certificate of Appreciation to San Jose Sharks representative
Rich Perez.
III. PRESENTATIONS TO COUNCIL
A. PUBLIC COMMENT BY MEMBERS OF THE PUBLIC ON ITEMS NOT ON THE
AGENDA, BUT WITHIN THE SUBJECT MATTER JURISDICTION OF THE CITY
COUNCIL
There were no public comments.
IV. REPORTS OF COUNCIL MEMBERS
Council Member Bracco spoke on the recent Gang Task Force meeting reporting that
the group had received 2 grants from the Rotary Club. He further explained that the
group would once again be holding Friday night out events at the MACSA gym and
would be kicking off a parent project at the Gilroy senior center.
Council Member Aulman announced that a ribbon cutting had been held at Gilroy
Gardens for the new water feature which would be opened to the public in June.
Council Member Peter Arellano joined the meeting at 06:06 p.m.

Mayor Pro Tempore Woodward spoke on patrol and response to calls at the local train
station by the Sheriff's office, explaining that he had spoken with the Captain
responsible for the transit division and had been assured the patrol issues would be
corrected. He then spoke on the recent meeting of the General Plan Advisory
Committee and their discussions of contemporary planning issues, announcing that the
full committee membership had been in attendance.
MAYOR'S REPORT
Mayor Gage reported that the Gilroy Downtown Business Association (DBA) had met
and had discussed the city's long range planning fee proposal and further explained that
the DBA was still in a negative position. He then spoke on the latest URM Task Force
meeting and building under review stating that the group would meet in March to
address another building.
V. FUTURE COUNCIL INITIATED AGENDA ITEMS
Mayor Pro Tempore Woodward submitted CalPERS prepayments, a protest buffer zone
ordinance and the library operating hours on Sundays as future Council agenda items.
The Council was in unanimous agreement to agendize the three items.

One (1) Year for Allocations Awarded to Country Estates IV (RD 92 -29)
Establishing a New Tentative Map Approval Deadline of March 19, 2015 and
Final Map Approval Deadline of March 19, 2016 (Le Garden House, LLC, Brent
Lee)

Rob Oneto spoke as representative for the project applicant sharing the allocations
issues in the first phase of the project and then spoke on the third phase stating that
instructions had been given at the time to bring back only one additional map for the last
two phases. He explained that the property had just recently been purchased by Mr.
Lee after the previous extension and Mr. Lee had already moved forward with the EIR
and new tentative mapping process, which would be completed within one year.

B. Consideration of an Economic Development Strategic Plan
The staff report was presented by Development Center Manager Butler.
Public comment was opened.
Walt Glines was called to speak explaining that the General Plan Committee had not
provided any input on the top priority items, and he urged the Council to send the item
to the committee for input as he didn't agree with the priorities as identified by staff.

Ron Kirkish spoke on the tax rates for vehicles verses the tax rate charged for other
retail type purchases.

D. Discussion of City Attorney Services
Mayor Gage spoke on the need for City Attorney services as the City Attorney was
retiring, stating that the Council could hire either a contract or in house City Attorney
explaining that a head hunting firm would need to be utilized if hiring an in house City
Attorney and a RFP would be sent out if hiring a firm.

Ron Kirkish was called to speak sharing his concerns with hiring an in house City
Attorney as the firm of Berliner Cohen had well represented the city for over 20 years.

for the selection of a firm to assist with recruiting for in house City Attorney
services - Mayor Gage, Mayor Pro Tempore Woodward and Council Member
