Memorandum of Understanding:
MOU between the City of Gilroy and the Gilroy Firefighters Local 2805
There were no public comments on closed session.
Special City Attorney Bill Ross provided the Council with advice on Item A explaining that the Council
was being asked to assert the Attorney Client privilege and adjourn to closed session as provided for
under the Brown Act and Gilroy Open Government Ordinance as the City had received a
communication from KB Home and developer Michael McDermott in disagreement to previously
negotiated terms of an agreement with the city, and in his opinion there was a substantial possibility of
potential litigation.
Motion to on Item II.A.
Motion was made by Mayor Pro Tempore Woodward, seconded by Council Member Tucker to
Assert the Attorney Client Privilege on Item A. and Adjourn to Closed Session
Vote: Motion carried 6 -0 -1.

The City Council unanimously agreed to remain in closed session on Items 11.13 and II.C. by
the following vote:
