Resolution 2014-28RESOLUTION NO. 2014-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING GPA 13 -01, AN AMENDMENT TO THE GENERAL PLAN CIRCULATION PLAN TO TERMINATE CAMINO ARROYO AT VENTURE WAY AND TO REALIGN THE FUTURE POSITIONS OF CAMERON BOULEVARD AND EAST LUCHESSA AVENUE, LOCATED WITHIN THE SOUTHEASTERN PORTION OF THE CITY OF GILROY, SPECIFICALLY ON ASSESSORS PARCEL NUMBERS 841 -17 -084 AND 115 WHEREAS, the current General Plan Circulation Plan shows (1) the planned extension of Luchessa Avenue toward the eastern boundary of the City; and (2) Camino Arroyo and Cameron Boulevard as public streets extending southward, through Assessor's Parcel Number ( "APN ") 841 -17 -115 to connect to the planned eastward extension of Luchessa Avenue; and WHEREAS, United Natural Foods, Inc. (UNFI) submitted application GPA 13 -01, a General Plan amendment request to amend the General Plan Circulation Plan to terminate Camino Arroyo at Venture Way and realign the future positions of Cameron Boulevard and East Luchessa Avenue, located within the southeastern portion of the City of Gilroy on APNs 841 -17- 084 and 115; and WHEREAS, the ultimate purpose of the planned extension of Camino Arroyo and Cameron Boulevard through APN 841 -17 -115 is to establish a roadway connection between the McCarthy Business Park and the planned future extension of Luchessa Avenue, to the south of the project site; and WHEREAS, United Natural Foods, Inc. (UNFI) has submitted Architectural and Site Permit request AS 13 -18, the site plan for which proposes the development of APNs 841 -17 -111, 112, and 115 with a warehouse and distribution facility ( "UNFI project, ") to be developed in two phases, with Phase 1 consisting of a 450,000 square foot building within the western portion of the parcel and a 10,000 square foot semi -truck maintenance and fueling facility within the eastern portion of the parcel; and with Phase 2 consisting of an approximately 360,000 square 4- 4839- 1687- 1195v3 RESOLUTION NO. 2014-28 X04706089 foot expansion of the Phase 1 building, to be constructed at a future date; and with parking, stormwater treatment, landscaping, and other associated improvements; and WHEREAS, the City of Gilroy acknowledges that for the UNFI project to be feasible, (1) the proposed Phase 1 building must be located partially within the planned extension of Camino Arroyo through the project site, as currently shown on the General Plan Circulation Plan, (2) and the associated improvements on the site, including semi -truck parking and circulation areas and semi -truck washing and fueling facilities must be located within the eastern portion of the project site, within the planned extension of Cameron Boulevard through the project site, as shown on the General Plan Circulation Plan; and WHEREAS, the City of Gilroy has determined that the intent of providing these roadway connection can be feasibly accomplished by terminating Camino Arroyo at Venture Way, and re- aligning the position of Cameron Boulevard through the eastern portion of the project site to gradually curve approximately 300 feet eastward; and WHEREAS, the termination of Camino Arroyo at Venture Way and the re- alignment of Cameron Boulevard through the eastern portion of the project site will allow the UNFI project to be feasibly constructed and operated; and WHEREAS, the planned alignment of Luchessa Avenue as shown on the General Plan Circulation Plan would run approximately parallel to the southern boundary of the project site, with a gap between the street alignment and the project boundary of approximately 166 feet in width; and WHEREAS, this gap would unnecessarily limit the lot depth of potential future parcels between Luchessa Avenue and the southern boundary of the project site, thereby constraining the configuration of potential future development of said parcels; and WHEREAS, the City of Gilroy desires to minimize constraints upon potential future development within this area; and has determined that shifting the position of the future -2- 4839- 1687- 1195v3 RESOLUTION NO. 2014-28 M04706089 alignment of Luchessa Avenue by approximately 84 feet to the south would allow for an increased gap of approximately 250 feet between the future alignment of Luchessa Avenue and the southern boundary of the project site, would serve to achieve this goal; and WHEREAS, an environmental impact report (EIR) entitled UNFI Warehouse and Distribution Facility (State Clearinghouse #201391002) evaluated the subject General Plan Amendments changes to the circulation network and determined that no significant impacts would result if two mitigation measures, as outlined in the EIR, were followed; and WHEREAS, the Planning Commission held a duly noticed public hearing on May 15, 2014 at which time the Planning Commission considered the public testimony, the staff report dated May 15, 2014, and all other documentation related to application GPA 13 -01, and recommended that the City Council approve GPA 13 -01; and WHEREAS, the City Council held a duly noticed public hearing on June 2, 2014 at which time the City Council considered the public testimony, the staff report dated June 2, 2014, and all other documentation related to application GPA 31 -01; and WHEREAS, on June 2, 2014, the Gilroy City Council certified the UNFI Warehouse and Distribution Facility EIR as being complete and in compliance with the California Environmental Quality Act ( "CEQA "); and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this project approval is based is the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED THAT: A. The City Council hereby adopts the following findings based upon substantial evidence in the record as follow; 1. The General Plan Circulation Plan amendments proposed by GPA 13 -01 are in the public interest because they further the goals of the General Plan for the economic development of -3- 4839- 1687- 1195v3 RESOLUTION NO. 2014-28 JH104706089 the city and provision of employment opportunities by facilitating the development of the LTNFI project, a major warehouse and distribution facility. 2. The analysis prepared by Hexagon Transportation Consultants determined that the proposed roadway network change would not cause level of service impacts at the key intersections under General Plan build -out conditions. 3. The analysis also determined there would be no negative impacts to the circulation network, as a roadway connection between the McCarthy Business Park and the future eastward extension of Luchessa Avenue would still be made, via the extension of Cameron Boulevard through the project site. B. Based on the above findings, General Plan Amendment application GPA 13 -01 is hereby approved, and the amendments to the General Plan Circulation Plan are attached hereto as Exhibit A and incorporated herein by this reference, are hereby adopted. C. This Resolution shall be in full force and take effect thirty (30) days after the date of its adoption.
