A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY DENYING AN AMENDMENT TO RD 92 -29, A
RESIDENTIAL DEVELOPMENT ALLOCATION FOR
COUNTRY ESTATES PHASE IV, FILED BY ENTERPRISE
REI 8, LLC
WHEREAS, Enterprise REI 8, LLC submitted an application requesting an amendment to the
approved residential development allocation for the Country Estates Phase IV subdivision; and
WHEREAS, the Country Estates phase IV subdivision is generally located north of Hecker
Pass Highway (State Route 152) and south of Mantelli Drive, adjacent to the Gilroy Golf Course and
consisting of approximately 153 acres; and
WHEREAS, the Country Estates phase IV subdivision obtained residential development
allocations in the 1992 residential development competition via application RD 92 -29; and
WHEREAS, the Country Estates phase IV subdivision originally was granted RDO
allocations for 25 townhome units and 70 estate lots, for a total of 95 RD allocations; and
WHEREAS, Enterprise REI 8, LLC requests eliminating the townhouse units and reducing
the estate lots to 61; and
WHEREAS, the Planning Commission of the City of Gilroy has considered the amendment
to RD 92 -29 in accordance with the Gilroy Zoning Ordinance, and other applicable standards and
regulations; and
WHEREAS, the Planning Commission of the City of Gilroy has considered the Staff Report
dated February 5, 2015, along with testimony received at the duly- noticed public hearing and other
materials; and
WHEREAS, residential development allocations are not considered projects pursuant to the
California Environmental Quality Act; and
WHEREAS, the Planning Commission of the City of Gilroy found that the modified project
is superior to the prior design; and
WHEREAS, the Planning Commission of the City of Gilroy found that the modified project
would result in a substantial improvement over the original project; and
WHEREAS, the City Council on March 16, 2015, found that the modified project would not
result in a substantial improvement over the original project; and
WHEREAS, the City Council found that the modified project was not superior to the original

project because the modified project resulted in the loss of condominium and townhome housing in
the R3 zone; the modified project may negatively impact the Housing Element because of its
potential loss of multi - family housing units; and the modified project may result in environmental
impacts to the sensitive hillside area.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy hereby
denies the amendment to RD 92 -29.
