A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
ADOPTING THE NORTH CENTRAL GILROY URBAN SERVICE AREA
AMENDMENT WATER SUPPLY ASSESSMENT FOR PROPERTY
COMPRISING APPROXIMATELY 721 ACRES LOCATED GENERALLY
NORTH OF THE EXISTING CITY LIMITS, SOUTH OF FITZGERALD
AVENUE, WEST OF MONTEREY ROAD AND EAST OF SANTA TERESA
BOULEVARD, GILROY
WHEREAS, Martin Limited Partnership: Jeffrey Martin submitted an application requesting
amendment of the City's Urban Service Area to include an area of approximately 721 acres located
to the north of the City; and
WHEREAS, the subject property is located within the City's 20 -year Growth Boundary; and
WHEREAS, the subject property is designated primarily for Neighborhood District land use,
with some portions designated for Commercial General Services, Hillside Residential, High Density
Residential, and Park/Recreational Facility; and
WHEREAS, the applicant submitted the North Gilroy Neighborhood Districts Urban Service
Area Modification Narrative ( "Narrative ") describing the land uses and circulation concepts for
future development of the requested Urban Service Area boundary amendment; and
WHEREAS, said the land uses and circulation concepts described in the Narrative are
generally in conformance with the General Plan land use map and circulation map, and consistent
with the City's Neighborhood District Policy; and
WHEREAS, SB -610 was signed into law in 2001 and requires the preparation and adoption
of a water supply assessment for projects over a specified size; and
WHEREAS, development outlined in the Narrative exceeds the thresholds established by SB-
610 and requires preparation of a water supply assessment; and

WHEREAS, the North Central Gilroy Urban Service Area Amendment Water Supply
Assessment ( "Water Supply Assessment ") has been prepared and City staff, City consultants, and the
City Council have reviewed said water supply assessment; and
WHEREAS, the City adopted its Urban Water Management Plan on June 6, 2011; and
WHEREAS, the City's Urban Water Management Plan has been incorporated by reference
into the Water Supply Assessment; and
WHEREAS, the City Council finds that the Water Supply Assessment identified a long -term
shortfall of water supplies for overall development within the City's General Plan 20 -year Growth
Boundary, and further identified that plans currently under development to increase the City's
recycled water supply would eliminate the shortfall and result in a surplus; and
WHEREAS, the adoption of a water supply assessment is not a discretionary action that
meets the definition of a project under the California Environmental Quality Act and no
environmental analysis is required; and
WHEREAS, the City is in the process of preparing an Environmental Impact Report for
consideration of the potential environmental effects of development of the site in accordance with
the conceptual land use and circulation concepts presented in the Narrative, and SB -610 requires
inclusion of the water supply assessment in the Draft EIR; and
WHEREAS, the City Council retains discretionary approval over the Urban Service Area
amendment application and future applications for specific plans, master plans, and development
entitlements, and can impose conditions of approval on those applications;

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby confums the
adequacy of, and adopts, the Water Supply Assessment.
