Minutes 2015/07/01City of Gilroy _City Council Meeting Minutes July 1. 2015 (.OPENING A. Call to Order Mayor Gage called the meeting to order at 6:00 p.m. The pledge of allegiance was led by Mayor Gage. The invocation was given by Melody Zarghami of the Bahai Faith Community City Clerk Shawna Freels announced that the agenda had been posted on June 24, 2015 at 11:00 a.m. Roll Call Present: Council Member Terri Aulman; Council Member Dion Bracco; Council Member Tucker; Council Member Roland Velasco; Mayor Pro Tempore Perry Woodward; Mayor Don Gage Absent/Excused: Council Member Peter Leroe -Munoz B. Orders of the Day There were no agenda changes. C. Introductions There were none. I. INTERVIEWS A. Interviews for Three (3) Public Seats on the High Speed Rail Station Planning Advisory Committee Interviews were conducted with David Almeida, Sharon Albert and Weston Hill. Council Member Peter Leroe -Munoz joined the meeting at 06:04 p.m. II. CEREMONIAL ITEMS A. Proclamations, Awards and Presentations There were none. 111. PRESENTATIONS TO COUNCIL A. PUBLIC COMMENT BY MEMBERS OF THE PUBLIC ON ITEMS NOT ON THE AGENDA, BUT WITHIN THE SUBJECT MATTER JURISDICTION OF THE CITY COUNCIL There were no public comments. B. Parks and Recreation Commission Annual Presentation to the City Council The presentation was given by Chair Garcia and Vice Chair Puente. IV. REPORTS OF COUNCIL MEMBERS City Council Meeting Minutes 7/1/2015 2 Council Member Velasco spoke on the Sister Cities Association need for housing for visitors from St. Clar, France during the Garlic Festival. He then spoke on beginning the new fiscal year, thanking city staff for their work in creating a budget that made for a smooth approval processes. Council Member Aulman explained that the SCRWA meeting had not been held due to lack of a quorum. Mayor's Report Mayor Gage spoke on the CaIGRIP grant funding for the South County Youth Task Force, the newly hired staff working in local schools and other uses of the grant monies with shared programming. He went on to speak on the late night gym program and focused gang prevention programs. He then spoke on scholarships awarded through the Gang Task Force and fundraising efforts of the golf tournament, and then announced the upcoming party in the park events and fundraising. He concluded by sharing compliment letters that had been received by the city and spoke on the Live Oak Adult Day Care Services event he had recently attended. V. PUBLIC HEARINGS A. Residential Development Ordinance Housing Exemption Request for 98 Affordable Housing Units for the Harvest Park Apartments Project Located at the Northwest Corner of Wren Avenue and Cohansey Avenue and at the Northwest Corner of Monterey Street and Cohansey Avenue; Applicant SV Affordable Investors, c/o James Suner (RDO HE 15 -01) Council Member Peter Leroe -Munoz recused himself from deliberations on the item, item due to property ownership within 500 feet of the subject site. He then left the Council Chambers. The staff report was presented by Planner II Durkin. The public hearing was then opened. James Suner was called to speak sharing his work with staff on the application. Ebere. Ezeka was called to speak sharing his concerns with the lack of communication when he purchased his home of the apartments that would be built. Raj Kandibanda was called to speak sharing his concerns with not knowing that the apartments would be built when he purchased his home in the neighborhood. He then spoke on issues with traffic circulation in the neighborhood and went on to share concerns with higher crime in low income housing areas, suggesting that the Council consider relocating the Wren and Cohansey portion. Miriam Padilla was called to speak homeowner at Harvest Park shared her concerns with the lack of communication with the developer previous to the meeting. She spoke on the growing number of apartments in the neighborhood and the correlation with housing prices being affected. She then spoke on the heightened crime. The public hearing was then closed. Council Member's Aulman, Velasco and Mayor Gage explained that they had each individually spoken with the applicant. Motion on Item VIII.A. Steve Ashford was called to speak sharing his thoughts on waiving fees for property owners with URM retrofit needs, and suggesting that a reduction in fees and fines would allow for the projects to move forward more quickly as there were different retrofit needs building by building. Public comment was then closed. B. An Ordinance of the City Council of the City of Gilroy Pertaining to the Expediting of Certain Solar Photovoltaic Installation Requests Consistent with AB 2188 The staff report was presented by Building Division Official Chung. CITY ATTORNEY'S REPORTS Acting City Attorney Faber spoke on a recent U.S. Supreme Court Case related to public speech and government speech and then spoke on a second case in the California Supreme Court related to inclusionary housing affordable housing. XI11. CLOSED SESSION A. John Tucker Business Agent for AFSCME Local 101 shared his concerns with the initial negotiation process, explaining the economic losses to city employees since 2010 and suggesting that the Council consider cost of living adjustments.
