RESOLUTION NO. 2015-51
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY REPEALING RESOLUTIONS NOS. 2015 -45
AND 201546 IN THEIR ENTIRETY
WHEREAS, pursuant to Utility Users Tax Ordinance No. 2007 -22 of the City of Gilroy
( "City"), and the Local Prepaid Mobile Telephony Services Collection Act, the City wishes to
enter into a contract with the State Board of Equalization ( "Board "), to perform all functions
incident to the administration and collection of the prepaid mobile telephony services surcharge
and local charges (Rev. & Tax. Code, Section 42101.5) to be effective January 1, 2016; and
WHEREAS, on August 17, 2015, the City Council adopted Resolutions Nos. 2015 -45
and 2015 -46, to establish the City's contractual relationship with the Board to perform the
necessary functions for the administration and collection of the prepaid mobile telephony
services surcharge and local charges; and
WHEREAS, since the adoption of Resolutions Nos. 2015 -45 and 2015 -46, the Board has
provided to the local jurisdictions template resolutions that are required to be used to avoid
unnecessary delay by the Board; and
WHEREAS, it now necessary to repeal the prior resolutions and adopt the Board
approved resolutions so that there will be no unnecessary delay by the Board in order for the City
to meet its September 30, 2015 deadline to be under contract with the board.
NOW, THEREFORE IT IS RESOLVED AND ORDERED THAT Resolution No's.
2015 -45 and 2015 -46 are hereby repealed in their entirety and are of no further force and effect.
