INTO THE CITY OF GILROY URBAN SERVICE AREA, FILED BY
MARTIN LIMITED PARTNERSHIP: JEFFREY MARTIN, 10756 GREEN
VALLEY DRIVE, GILROY, CA 95020
WHEREAS, the Gilroy 2020 General Plan was adopted by the Gilroy City Council on
June 13, 2002 and designates the subject property with Neighborhood District, General Services
Commercial, High Density Residential, Hillside Residential, and Open Space land use
designations; and
WHEREAS, Martin Limited Partnership: Jeffery Martin submitted Urban Service Area
Amendment application USA 14 -01 requesting that the City of Gilroy incorporate approximately
721 acres of land into its Urban Service Area; and
WHEREAS, the subject property is generally located west of Monterey Road, south of
Fitzgerald Avenue, east of Santa Teresa Boulevard, and north of the existing Urban Service Area
boundary; and
WHEREAS, Action 2.A of the 2020 General Plan requires USA applications to be
reviewed based on the following criteria: A) The need for additional lands, if any, to
accommodate projected growth for the next five years; B) Consistency of the proposed area of
Urban Service Area expansion in light of General Plan policies regarding the pattern of
development (1.01), the location of growth (2.01), and the rate and timing of growth (2.02); and
C) Consistency with implementation strategies for the Neighborhood Districts, including phasing

strategies, if applicable (based on outcome of Action 1.C).
WHEREAS, the City Council of the City of Gilroy has considered Urban Service Area
Amendment application USA 14 -01 in accordance with the Gilroy 2020 General Plan and other
applicable standards and regulations; and
WHEREAS, City staff referred Urban Service Area Amendment application USA 14 -01
to various public agencies and City departments; and
WHEREAS, the City Council of the City of Gilroy has considered the Vacant Land
Inventory, Fiscal Impact Analysis, Local Agency Formation Commission policy analysis, and
Plan for Services prepared for USA 14 -01; and
WHEREAS, the Planning Commission considered the Environmental Impact Report
(EIR) for USA 14 -01 at a special meeting on November 19, 2015, and a motion to recommend
certification of the EIR failed; and
WHEREAS, the Planning Commission of the City of Gilroy considered USA 14 -01 at a
special meeting on November 19, 2015, and unanimously recommended denial of the Urban
Service Area amendment, and the City Council of the City of Gilroy has considered that
recommendation; and
WHEREAS, the City Council of the City of Gilroy held a duly noticed public hearing on
December 7, 2015; and
WHEREAS, the City Council of the City of Gilroy finds that the final environmental
impact report (EIR) was completed for this project in compliance with the California
Environmental Quality Act and reflects the independent judgment of the City, and therefore,
certified the North Gilroy Neighborhood Districts Urban Service Area Amendment EIR at a
regular meeting on December 7, 2015; and
WHEREAS, the City Council of the City of Gilroy finds, after due study, deliberation,
and public hearing, the following circumstances exist:
A. The Urban Service Area request is for property located within the City's 20 -year
Growth Boundary;
B. The Urban Service Area request is on the whole consistent with Gilroy General Plan
policies and goals regarding the pattern of development, the location of growth, the
rate and timing of growth, and expansion of the City's Urban Service Area;
C. Annexation and adoption of a specific plan will be required prior to consideration of
development entitlements;
D. The Urban Service Area amendment will promote comprehensive planning for land
use, storm water drainage, utilities, and circulation, and future development within

the Urban Service Area request will be phased in accordance with 2020 General Plan
Policies, Neighborhood District Policy, the Residential Development Ordinance and
adopted Specific Plan;
E. The City currently has an approximate 7.4 -year supply of vacant residential land
suitable for the envisioned types of housing for the North Gilroy Neighborhood
District and, in light of the protracted process to prepare a specific plan and annex
land, increasing the land supply at this time by expanding the City's Urban Service
Area boundary is needed to accommodate projected growth for the next five years;
F. Although the Urban Service Area request will create a negative fiscal impact on the
city, the applicant has an agreement to offset impacts to the school district as the
property develops and the City will initiate financing district(s) to offset excess costs;
G. The North Gilroy Neighborhood Districts Urban Service Area Amendment
Environmental Impact Report was completed in compliance with the California
Environmental Quality Act, and contains adequate analysis to support approval of the
project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy hereby
approves the North Gilroy Neighborhood Districts Urban Service Area Amendment (USA 14-
01) adding 721 acres of land to the City's Urban Service Area, and directs the City Administrator
to submit an Urban Service Area Amendment application to the Local Agency Formation
Commission.
