A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY DECLARING A VACANCY IN THE OFFICE OF
MAYOR, AND DIRECTING THE CITY CLERK TO POST A
NOTICE OF INTENTION TO FILL A VACANCY ON THE
GILROY CITY COUNCIL AND ADVERTISE FOR
APPLICATIONS TO FILL THE VACANCY
WHEREAS, Donald F. Gage was elected as Mayor of the City of Gilroy at a duly called and
ordered General Municipal Election held in the City on November 6, 2012; and
WHEREAS, Donald F. Gage assumed the office of the Mayor on December 7, 2012; and
WHEREAS, a vacancy in the office of Mayor of the City of Gilroy will exist as a result of
Mayor Gage's resigning his seat on December 7, 2015, to be effective on December 31, 2015; and
WHEREAS, the Charter of the City of Gilroy Section 503 governs the process to fill a
vacancy in the office of Mayor through the appointment process; and
WHEREAS, it is the desire of the Council to fill the vacancy in the office of Mayor on
January 4, 2016; and
WHEREAS, pursuant to the Charter of the City of Gilroy Section 406, if the Council fails to
fill a vacancy by appointment within thirty (30) days after such an office become vacant, it shall
cause an election to held to fill such vacancy.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GILROY:
1. That the Council hereby declares a vacancy in the office of Mayor as of January 1, 2016.
2. That, pursuant to the Charter of the City of Gilroy Section 503, on January 4, 2016, the
Council shall appoint a member of the Council to fill said vacancy.
3. That, pursuant to the Charter of the City of Gilroy Section 503, the member of the Council
who fills said vacancy shall serve until the next General Municipal Election to be held on
November 8, 2016 is certified, when a Mayor shall be elected to serve for a full four -year
term.

4. That, pursuant to the Charter of the City of Gilroy Section 502, on January 4, 2016, the
Council shall elect a member of the Council as Mayor Pro Tempore, if applicable.
5. That the Council hereby directs the City Clerk to post a notice of intention to fill the
vacancy on the Gilroy City Council to be created by the appointment of a member of the
Council as Mayor and to advertise for applications to fill the vacancy.

December, 2015, by the following roll call vote:
