A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING RDO HE 15 -03, AN APPLICATION
FOR AN RDO DOWNTOWN HOUSING EXEMPTION FOR
DEVELOPMENT OF 104 APARTMENT UNITS ON
APPROXIMATELY 4.94 ACRES LOCATED AT 111 LEWIS
STREET, APN 841 -04 -029
WHEREAS, Meta Housing Corporation ( "Applicant') submitted RDO HE 15 -03
requesting 104 Residential Development Ordinance (RDO) Housing Exemption units to build
The Cannery at Lewis Street apartment project; and
WHEREAS, the subject property is located at 111 Lewis Street, Assessor Parcel Number
841 -04 -029; and
WHEREAS, the 4.94 + /- acre site is located within the Cannery District zoning
designation where the allowable density is 40 du/acre or 198 units; and
WHEREAS, the City has determined that the review and approval of an application for
an RDO Housing Exemption allocation does not confer any entitlement for residential
development and therefore is not a "project' for the purposes of review pursuant to California
Environmental Quality Act CEQA: and
WHEREAS, the Planning Commission reviewed application RDO HE 14 -02 at a
duly noticed public hearing on November 5, 2015; and recommended that the City Council
approve allocation of 75 RDO Housing Exemption units; and
WHEREAS, on February 1, 2016 the City Council considered the Staff Report dated
February 1, 2016 along with testimony received at a duly- noticed public hearing; and
NOW, THEREFORE, BE IT RESOLVED that the City Council approves RDO
HE 15 -03, subject to the following conditions attached as Exhibit A and incorporated by this
reference.

PLANNING DIVISION STANDARD CONDITION:
The developer shall obtain approval of Architectural and Site review application
A/S 15 -41 within two (2) years from the date of RDO Housing Exemption
approval; otherwise, the RDO Housing Exemption approval shall be deemed
automatically revoked. Upon application prior to the expiration of the approval
and for good cause shown, the Planning Division Manager may grant an
extension of time not to exceed one year.
PLANNING DIVISION SPECIAL CONDITION:
2. The developer shall conduct a public outreach meeting to discuss the project
design. This meeting shall be facilitated by city staff..
