RESERVING NEVERTHELESS, unto Grantor an easement to construct, reconstruct, inspect, maintain and repair channel protection works and appurtenant structures within the above - described parcel; provided that this reservation and nothing herein contained shall be construed as an assumption or acceptance by Grantor District of responsibility for the construction, reconstruction, repair and maintenance in a condition not dangerous or defective of any roadway or structure erected by Grantee City across said channel or within said easement area. Furthermore it is agreed as follows: THAT City accepts full responsibility for operation and maintenance of storm drain outfalls within the box culvert and wing walls, as well as structural maintenance of the reinforced concrete box culvert. District agrees to remove sediment and vegetation in and around the box culvert area.
