SANTA CLARA VALLEY WATER DISTRICT, a public corporation ( "District ") does hereby
grant to CITY OF GILROY, hereinafter "City ", all that real property in the City of Gilroy,
County of Santa Clara, State of California, described as follows:
Being a portion of South Morey Channel as described in those certain Grant Deeds filed for record at
Book K202 at page 369 and at Book 0205 at page 418, Official Record of Santa Clara County,
California, more particularly described as follows:
COMMENING at the most Southwesterly corner of Parcel B as shown on that certain Parcel Map filed
for record on December 15, 1998 in Book 710 of Maps at pages 50 and 51, Official Records of said
Santa Clara County, and being a point on the Northerly right of way line of said South Morey Channel
and being a point on the Easterly right of way line of Santa Teresa Boulevard as shown on said Parcel
Map; thence North 89 °27'30" East, departing said Easterly right of way and along said Northerly right
of way and said Southerly boundary line of Parcel B, 555.94 feet; thence North 89 132'51" East,
continuing along said Northerly right of way and said Southerly boundary line, 187.03 feet to the
POINT OF BEGINNING; thence continuing North 89 °32'51" East, along said Northerly right of way
and said Southerly boundary line, 110.00 feet to the POINT OF CUSP of a non - tangent curve having
a radius of 20.00 feet, a radial line to said point bears North 00 127'09" West; thence Southwesterly
along said curve, 31.42 feet, departing said Northerly right of way and said Southerly boundary line,
through a central angle of 90 °00'00 "; thence South 00 °27'09" East, 55.00 feet to a point on the
Southerly right of way line of said South Morey Channel and being the most Northeasterly corner of
Hirasaki Avenue as shown on that certain Final Map entitled "Tract No. 8750 - Glenbrook Unit 1"
filed for record in Book 669 of Maps at pages 49 and 50 and being a point on the Northerly boundary
line of said Final Map; thence South 89 °32'51" West, along said Northerly boundary line map and
said Southerly right of way, 70.00 feet, to the most Northwesterly corner of said Hirasaki Avenue,

55.00 feet to the beginning of a tangent curve having a radius of 20.00 feet; thence Northwesterly
along said curve, 31.42 feet through a central angle of 90 000'00", to a point on the Northerly right
of way of said Morey Channel common with the Southerly boundary line of said Parcel A, said point
also being the POINT OF BEGINNING as shown on Exhibit B attached hereto and made a part
hereof.
Containing 5,422 square feet, or 0.124 -acre of land, more or less.
Basis of Bearings:
The Bearing (North 04 °55'54" East) of the centerline of Santa Teresa Boulevard (formerly Morey
Avenue), as shown on that certain Record of Survey Map filed in Book 478 of Maps at pages 14
through 20, was used as the basis for all bearings for this legal description.
RESERVING NEVERTHELESS, unto Grantor an easement to construct, reconstruct, inspect,
maintain and repair channel protection works and appurtenant structures within the above - described
parcel; provided that this reservation and nothing herein contained shall be construed as an
assumption or acceptance by Grantor District of responsibility for the construction, reconstruction,
repair and maintenance in a condition not dangerous or defective of any roadway or structure erected
by Grantee City across said channel or within said easement area.
Furthermore it is agreed as follows:
THAT City accepts full responsibility for operation and maintenance of storm drain outfalls within
the box culvert and wing walls, as well as structural maintenance of the reinforced concrete box
culvert. District agrees to remove sediment and vegetation in and around the box culvert area.
