A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY, CALIFORNIA, ACCEPTING THE SUBMISSION OF
THE CERTIFICATION OF THE CITY CLERK AS TO THE
SUFFICIENCY OF THE INITIATIVE PETITION ENTITLED
"GILROY URBAN GRO WTH BOUNDAR Y INITL4 TIVE" AND
ORDERING THE ELECTIONS CODE SECTION 9212 REPORT
WHEREAS, on February 26, 2016, proponents of an initiative measure entitled
"Gilroy Urban Growth Boundary Initiative" submitted to the City Clerk a Notice of
Intention and written text of the measure and requested that a title and summary for
the measure be prepared by the City Attorney in order to circulate the petition; and
WHEREAS, on March 11, 2016, the City Attorney prepared an official ballot
title and summary for the proposed Initiative for use by the proponents for publication
and circulation of the petition, and said title and summary were provided to the
proponents by the City Clerk on March 11, 2016; and
WHEREAS, on February 26, 2016, the City Clerk contacted the Santa Clara
County Registrar of Voters Office to ascertain the number of registered voters in the City
of Gilroy, as of its last report to the Secretary of State, pursuant to California Elections
Code Section 2187; that number of registered voters in the City being 19,229 as of
January 6, 2016, and;
WHEREAS, per California Election Code Sections 9215 and 9214 respectively,
the initiative petition would require at least 1923 (10 %) valid signatures to be sufficient
to qualify for a regular election, and at least 2884 (15 %) valid signatures to qualify for a
special election; and
WHEREAS, the initiative petition was filed with the City Clerk on May 2, 2016,
and the City Clerk reviewed the petition for sufficiency as to content and format, and
subsequently delivered it to Santa Clara County Registrar of Voters on May 9, 2016 for
100% signature verification; and

WHEREAS, the results of the signature verification conducted by the Santa Clara
County Registrar of Voters established that 3,573 signatures were on the petition and
were examined, of which 2,743 were found to be sufficient; and
WHEREAS, the number of signatures qualified is in excess of the minimum
number of signatures required for an election pursuant to California Election Code
Section 9215; and
WHEREAS, the City Clerk has determined that the petition is sufficient as to
signature count, format and content, and has prepared the Certificate of Sufficiency of the
Initiative Petition attached hereunto as Exhibit "A "; and
WHEREAS, Elections Code Section 9114 requires that the certification of the
voter initiative petition be submitted to the City Council at the next regular City Council
meeting following said certification.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL:
1. That on June 20, 2016, the City Clerk submitted the Certificate of Sufficiency
regarding the Gilroy Urban Growth Boundary Initiative petition to the City
Council of the City of Gilroy. Said Certificate of Sufficiency is attached
hereto as Exhibit "A" and is accepted by the City Council.
2. That pursuant to Elections Code Section 9215, the City Council of the City of
Gilroy hereby orders an Elections Code Section 9212 Report (which report is
currently in preparation) to be submitted to the City Council at a regular
meeting no later than 30 days from June 20, 2016.
3. That upon the presentation of the report prepared pursuant to Elections Code
Section 9212, the City Council of the City of Gilroy shall either: (a) adopt the
ordinance within 10 days or (b) order an election.

attached Resolution No. 2016 -34 is an original resolution, or true and correct copy of a city
Resolution, duly adopted by the Council of the City of Gilroy at a regular meeting of said
Council held on the 20`h day of June, 2016 at which meeting a quorum was present.
