Minutes 2016/12/19City of Gilroy City Council Meeting Minutes December 19, 2016 I. OPENING A. Call to Order Mayor Woodward called the meeting to order at 6:10 p.m. The pledge of allegiance was led by Council Member Tucker. The Invocation was given by Pastor Malcolm MacPhail of New Hope Community Church. City Clerk Shawna Freels announced that the agenda had been posted on December 14, 2016 at 11:00 a.m. Roll Call Present: Council Member Terri Aulman; Council Member Dion Bracco; Council Member Daniel Harney; Mayor Pro Tempore Peter Leroe- Munoz; Council Member Cat Tucker; Council Member Roland Velasco; Mayor Perry Woodward B. ORDERS OF THE DAY There were no agenda changes. C. PUBLIC COMMENT ON ITEMS NOT ON THE AGENDA BUT WITHIN THE SUBJECT MATTER JURISDICTION OF THE CITY COUNCIL There were no public comments. II. CONSENT CALENDAR A. Minutes of the December 5, 2016 Regular Meeting B. Certificate in Recognition of Tyler Stephenson for Achieving Eagle Scout Rank Motion on the Consent Calendar Motion: to Approve Consent Calendar Items A and B Moved by Mayor Pro Tempore Peter Leroe- Munoz, seconded by Council Member Cat Tucker. Vote: Motion carried 7 -0. NEW BUSINESS A. Official Canvass of the November 8, 2016 Municipal Election Results The staff report was presented by City Clerk Freels. There were no public comments. City Council Meeting Minutes 12/19/2016 Motion on Item III.A. Motion: to Adopt Resolution 2016 -63 of the City Council of the City of Gilroy Declaring the Acceptance of the Statement of Votes of the November 8, 2016 Municipal Election and Certification of Said Election Results Moved by Mayor Pro Tempore Peter Leroe- Munoz, seconded by Council Member Terri Aulman. Vote: Motion carried 7 -0. Yes: Council Member Terri Aulman; Council Member Dion Bracco; Council Member Daniel Harney; Mayor Pro Tempore Peter Leroe- Munoz; Council Member Cat Tucker; Council Member Roland Velasco; Mayor Perry Woodward Mayor Woodward presented plaques to Council Member's Terri Aulman and Daniel Harney and each Council Member gave their farewell remarks Mayor Pro Tempore Leroe -Munoz presented a plaque to Mayor Perry Woodward and Mayor Woodward gave his farewell remarks. City Clerk Freels gave the oath of office to incoming Council Member's Tucker, Kloecker and Tovar and presented them with certificates of election. City Clerk Freels then gave the oath of office to Mayor Velasco and presented him with a certificate of election. The Council adjourned Sine Die to a reception honoring the retiring Council Members, and newly elected Council Members. The City Council returned to open session Roll Call Present: Council Member Dion Bracco; Mayor Pro Tempore Peter Leroe- Munoz; Council Member Cat Tucker; Council Member Fred Tovar; Council Member Paul Kloecker; Mayor Roland Velasco Incoming Council Member's Tovar, Tucker and Kloecker gave incoming remarks. Mayor Velasco gave his incoming remarks. B. Declaration of a Vacancy on the City Council and Consideration of Filling the Vacancy for the Remainder of an Unexpired Term Ending November, 2018 City Clerk Freels presented the staff report. Public comment was opened. Bill O'Connor was called to speak stating that he believed the next candidate during the Council election with the next highest number of votes should be appointed to the vacant seat. Ron Kirkish was called to speak stating that he believed Daniel Harney had done a very good job during his appointed time on Council and would be the best choice. Walt Glines was called to speak stating that he believed the voters had chosen Tom Fischer as the next highest vote getter and he believed Tom should be selected. Elizabeth Bracco was called to speak sharing her thoughts on appointing Daniel Harney as he had represented the Council well during his prior appointment. City Council Meeting Minutes 12/19/2016 Ron Gurries was called to speak sharing his support of appointing Daniel Harney to the vacant seat. Susan Mister was called to speak sharing her support of appointing Daniel Harney to the vacant seat. Daniel Harney was called to speak and stated that he would be honored to serve on the Council. Public comment was closed. Motion on Item III.B. Motion: Approve Adoption of Resolution 2016 -64 of the City Council of the City of Gilroy Declaring a Vacancy in the Office of City Council Moved by Council Member Dion Bracco, seconded by Council Member Cat Tucker. Vote: Motion carried 6 -0. Yes: Council Member Dion Bracco; Mayor Pro Tempore Peter Leroe- Munoz: Council Member Cat Tucker; Council Member Fred Tovar; Council Member Paul Kloecker; Mayor Roland Velasco Second Motion on Item III.B. Motion: to Appoint Daniel Harney to fill the Vacancy on Council for the remainder of an unexpired term ending in November, 2018. Moved by Council Member Dion Bracco, seconded by Council Member Cat Tucker. Vote: Motion carried 5 -1. Yes: Council Member Dion Bracco; Council Member Cat Tucker; Council Member Fred Tovar; Council Member Paul Kloecker; Mayor Roland Velasco . No: Mayor Pro Tempore Peter Leroe -Munoz C. Selection of Mayor Pro Tempore Mayor Velasco presented the item. Motion on Item III.C. Motion: Approve Motion to Appoint a Council Member Dion Bracco to Serve as Mayor Pro Tempore Moved by Mayor Roland Velasco, seconded by Council Member Paul Kloecker. Vote: Motion carried 4 -3.
