A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING RDO HE 16 -01, AN
APPLICATION TO AWARD RESIDENTIAL
DEVELOPMENT ORDINANCE INTERIM EXEMPTION
UNITS TO THE SOBRATO APARTMENT PROJECT
LOCATED AT 9369 MONTEREY ROAD, APN 790 -07 -027
WHEREAS, Eden Housing ( "Applicant ") submitted RDO HE 16 -01, requesting allocation
of 60 Residential Development Ordinance (RDO) units to the Sobrato Apartment project pursuant
to Gilroy City Code section 30.50.60(b)(2) 1, "RDO Interim Exemption for Projects on Properties
without Previously Awarded Allocations"; and
and
WHEREAS, the subject property is located at 9369 Monterey Road (APN 790 -07 -027);
WHEREAS, the City has determined that the review and approval of an application for an
RDO Housing Exemption does not confer any entitlement for residential development and
therefore is not a "project" for the purposes of review pursuant to the California Environmental
Quality Act; and
WHEREAS, the Planning Commission reviewed application RDO HE 16 -01 at a duly
noticed public hearing on December 1, 2016; and recommended that the City Council approve the
RDO Housing Exemption application RDO HE 16 -01.
WHEREAS, on January 9, 2017 the City Council considered the Staff Report dated
January 9, 2017 along with the testimony received at a duly- noticed public hearing; and
NOW, THEREFORE, BE IT RESOLVED that the City Council approves RDO HE 16 -01.
