Minutes 2017/04/17City of Gilroy City Council Meeting Minutes April 17, 2017 I. OPENING A. Call to Order Mayor Velasco called the meeting to order at 6:01 p.m. The pledge of allegiance was led by Mayor Pro Tempore Bracco. The Invocation was given by Pastor Chris Soto of New Hope Community Church. City Clerk Shawna Freels announced that the agenda had been posted on April 12, 2017 at 3:00 p.m. Roll Call Present: Mayor Pro Tempore Dion Bracco; Council Member Daniel Harney; Council Member Paul Kloecker; Council Member Peter Leroe- Munoz; Council Member Fred Tovar; Council Member Cat Tucker; Mayor Roland Velasco B. Orders of the Day C. Employee Introductions Interim Public Works Director Roberts introduced newly promoted Senior Maintenance Workers Marshall Silva and Steve McDonald. II. CEREMONIAL ITEMS A. Proclamations, Awards and Presentations There were none. III. PRESENTATIONS TO THE COUNCIL A. PUBLIC COMMENT BY MEMBERS OF THE PUBLIC ON ITEMS NOT ON THE AGENDA BUT WITHIN THE SUBJECT MATTER JURISDICTION OF THE CITY COUNCIL Rachelle Bedell was called to speak sharing the community day of service. Ron Kirkish was called to speak correcting information he had sent in a previous email regarding growing marijuana in a home. Zachary Hilton was called to speak describing the need to have continuous events in the downtown to boost the local economy. He asked that the Council consider the appointment of public members to both to the EDC and Downtown Business Association when renewing contracts, suggesting that any contract be performance based and meetings be open to the public. He spoke on the success of Gilroy Gardens and the Welcome Center in generating sales tax for the local economy and described the 1St Friday night events, sharing social media statistical data from the events. Gary Walton was called to speak on behalf of the Gilroy Red Barn Association announcing their fundraising dinner event on June 17th. He then thanked the City for waiving permitting fees for the roof repair project. He then spoke on the increases in sales tax revenue in the downtown verses the outlet center and shared the successes of the Downtown Business Association in promoting the downtown economy. He explained that all agendas of Downtown Business Association City Council Meeting Minutes 4/17/2017 2 meetings were published on the Association website and Board meetings rotated between businesses to highlight the Association offerings with individual businesses. Judy Hess was called to speak and explained that the Gilroy community garden was a great success and she wanted to see the continuance of the garden, describing the educational outreach to youth, seniors, homeless and others in the community. She spoke on the agricultural heritage of Gilroy and asked the Council to support the garden's efforts within the next budget cycle. IV. REPORTS OF COUNCIL MEMBERS Mayor Pro Tempore Bracco spoke on the opening of the New Horizons adult day care business at the old Dispatch building. Council Member Tucker spoke on the Gilroy Welcome Center's recent success in Gilroy being selected by the Canadian Traveler Magazine as one of 26 top American trips for 2017. She spoke on the Visit California feature of the Circus Trees at Gilroy Gardens through social media channels and announced the Welcome Center May 10th celebrate tourism event. She then concluded by reporting on the joint participation of the Welcome Center and Garlic Festival Association at an upcoming Sonoma tourism event. Council Member Harney spoke on the VTA Next Gen plan update and adjustments to the rider service plan. He spoke on the low bus ridership in Gilroy and VTA's review of the needs in the community for students, healthcare and social service facilities. He concluded by explaining that new bus route paths were being created to incorporate existing lines, and described the support received for Gilroy's VTA bus services. Council Member Tovar spoke on his meeting with Gilroy Gardens staff to become updated on their goals, he thanked Zachary Hilton for his comments explaining that he would relay them to the Downtown Business Association, and he concluded by speaking on the work of the Youth Alliance in encouraging youth towards higher education. Council Member Leroe -Munoz spoke on the Silicon Valley Clean Energy Authority meeting and the availability of the clean energy in south County. He then announced the Cities Association meeting on May 11th at 6 p.m.at the Institute for the Future. Mayor Velasco spoke on the work of the Economic Development Corporation to bring in new downtown businesses including a brew -pub and the stomping ground, describing the continued work of the EDC with downtown property owners to facilitate businesses locating in the downtown V. FUTURE COUNCIL INITIATED AGENDA ITEMS Mayor Velasco suggested that a study session on the VTA Next Gen Plan and Measure B monies be held. All Council Members agreed to hold the study session. VI. Public Hearing to Establish a List of Properties Subject to the Weed Abatement Program and Adoption of a Resolution Ordering the Fire Chief to Abate the Nuisance Arising Out of Weeds Growing and Refuse Accumulating Upon Property in the City of Gilroy Pursuant to Section 12.51 of the Gilroy Code The staff report was presented by Fire Marshal Bretschneider. The public hearing was opened; there being no comments, it was then closed. Motion on Item VIII.A. Motion: Adoption of Resolution 2017 -12 of the City Council of the City of Gilroy Ordering The Fire Chief To Abate The Nuisance Arising Out Of Weeds Growing And Refuse Accumulating Upon Property In The City Of Gilroy, Pursuant To Section 12.51 Of The Gilroy City Code. The staff report was presented by Grant Coordinator Murillo. The public hearing was opened. Connie Rogers was called to speak thanking the Council for the affordable housing. She then asked who was building the housing explaining that higher design. standards should be upheld. Anthony Stubs of California Municipal Financing Authority explained that there was no approval of the project tied to the TEFRA financing hearing. The public hearing was then closed. Motion: Adoption of Resolution 2017 -13 of the City Council of the City of Gilroy Approving the Issuance of Revenue Bonds by the California Municipal Finance Authority (CMFA) in an Aggregate Principal Amount Not to Exceed $40,000,000 for Gilroy Lewis Street, L.P. UNFINISHED BUSINESS A. Approval of 2040 General Plan Work Program The staff report was presented by Senior Planner Ketchum. Connie Rogers was called to speak thanking the Council for inviting the new wider range of organizations to the General Plan Committee explaining that it would become a more fully inclusive committee. Bill O'Connor was called to speak stating that the community input during the public workshop sessions didn't have any impact on the decisions made by the committee. Carolyn Tognetti was called to speak sharing her experience on the general plan committee and explaining that the community's wishes were put in place with Measure H. She then stated that the full membership should be 30, with more members at large. Tom Fischer was called to speak explaining that he too believed the number of members at large should be increased to balance out to the stakeholder organizations. He then explained that if a member at large dropped off the committee they needed to be replaced to eliminate the imbalance of private interest groups to the public at large. Motion: Approval of the proposed work program, schedule and budget for the resumption of the 2040 General Plan process; approval of the revised composition of the General Plan Advisory Committee to a total of 30 members, with the inclusion of 1 youth commissioner and 3 public members at -large and 3 alternate public members at- large; and direction to the City Administrator to execute an amendment to the Agreement for Services with Mintier Harnish for an amount not to exceed $687,000. Bill O'Connor was called to speak explaining that savings typically meant what didn't get done that caused the reduction in spending. He then spoke on the development of a reserve policy and the identification of the use of the reserve funding. B. Budget Amendment for Engineering Services The staff report was presented by Community Development Director Abrams. There were no public comments.
